If written notice of a default to the Lessee is required under this Lease, then Landlord also will deliver written notice of such default to the Investor, if applicable, and the primary lender, if applicable, at their respective addresses given below (or such other single address as may be provided in writing) for as long as the Investor has an ownership interest in Lessee or the primary lender qualifies as a Permitted Leasehold Mortgagee.
Landlord shall accept such performance by or at the instigation of such Permitted Leasehold Mortgagee as if the same had been done by Tenant.
Compensable items shall include: Forecasted 41 annual hours of employment, paid holidays and paid vacations.
Such costs include, but are not limited to, any costs, expenses, liabilities, charges or other sums, in connection with the closing of a Permitted Leasehold Mortgage or Permitted Leasehold Mortgagee, and/or otherwise incurred by Landlord in connection with a Permitted Leasehold Mortgage or Permitted Leasehold Mortgagee, all of which costs, expenses, liabilities, charges or other sums shall be deemed Additional Rent.
No such notice by Landlord to Tenant shall be deemed to have been duly given unless and until a copy thereof has been sent, in the manner prescribed in Article XXXV of this Lease, to every such Permitted Leasehold Mortgagee for which notice has been properly provided to Landlord pursuant to Section 17.1(b)(i) hereof.
