Permit to Enter definition

Permit to Enter is defined in the DDA. “Person” is defined in the DDA.
Permit to Enter means, an agreement executed by the Agency and Vertical Developer in accordance with Article 9, which agreement shall be substantially in the form of Attachment L with only such changes as may be approved by the Agency and Vertical Developer, or as reasonably required by the Agency in connection with site specific requirements. The Agency, may from time to time amend the attached form of Permit to Enter to impose such insurance, bond, guaranty and indemnification requirements as the Agency determines are necessary or appropriate to protect its interests, consistent with the Agency’s custom and practice and in a manner that will not unnecessarily interfere with or materially increase the cost or risk of Vertical Developer’s ability to perform under this Agreement or, if it would unnecessarily interfere with or materially increase such cost or risk, such amendment must be consistent with commercial industry practice.
Permit to Enter means, initially, the document attached to this DDA as Exhibit HH, as such document may be revised from time to time by the Authority upon notice thereof to Developer. The Authority may from time to time amend the attached form of Permit to Enter and impose such insurance, bond, guaranty and indemnification requirements as the Authority determines are necessary or appropriate to protect its interests, consistent with the Authority’s custom and practice and in a manner that will not unnecessarily interfere with or materially increase the cost or risk of Developer’s ability to perform under this DDA or if it would unnecessarily interfere with or materially increase the cost or risk, such amendment must be consistent with commercial industry practice.

Examples of Permit to Enter in a sentence

  • The Consultant shall comply with all conditions imposed by the Caltrans Contract Manager and requirements set forth in the Permit to Enter.

  • Engineer’s Representative means the official in the civil/ electrical engineering department who is authorized to be in-charge of the work to which these presents relate. It shall include any other official nominated to attend to the supervision of day to day execution of the work to which this CONTRACT relates.

  • Construction Phase means that Phase of the Project which shall commence after the Authority provides the Trade Contractor with written Notice to Proceed with the Construction Phase.

  • Municipal Engineer means the engineer for the Municipality or such person or persons designated in writing from time to time by the Municipality.

  • County Superintendent means the Executive County Superintendent of Schools designated by the Department of Education for this school district.

  • State superintendent means the state superintendent of public instruction.

  • Civil engineer means a professional engineer registered in the state of California to practice in the field of civil engineering.

Code Ann., Ch. 1001, and/or a firm employed by Owner or Design-Build Contractor to provide professional architectural or engineering services and to exercise overall responsibility for the design of a Project or a significant portion thereof, and to perform the contract administration responsibilities set forth in the Contract.
