Upon failure of the Operator to pay the Per Trip Fee at the time and in the manner herein set forth or upon the default by the Operator in the performance of any of the other terms or conditions of the Agreement, the Authority may at its own option, terminate this Agreement and all rights, privileges and accesses herein granted.
The Per Trip Fee established by the Airports Authority shall be as set forth below.
The Monthly License fee is the greater of (1) $25,000 or (2) the product of (a) the number of Trips conducted by Licensee’s TNC Vehicles in one calendar month and (b) the Per Trip Fee then in effect.
The Airport will allow Operator and its Drivers to pass on the Per Trip Fee paid under this Agreement to their passengers.
Within ninety (90) days following the end of each Contract Year, the Contractor, at its own cost and expense, shall perform a reconciliation of all fees previously paid to the Airports Authority during the Contract Year and provide to the Airports Authority schedules of the Gross Receipts, outbound trips including those not carrying any passengers, and the calculation of the Annual Per Trip Fee due for the Contract year.
