Owner Delay definition

Owner Delay means, and is limited to, a Critical Delay to Contractor’s completion of the Work to the extent caused by one or more of the following: (i) Change Orders and Construction Change Directives (CCDs) (excluding minor changes in the Work and Design Professional interpretations), (ii) the Owner’s failure (or that of any other person for whom the Owner is responsible to the Contractor, including the Design Professional or a separate contractor hired by the Owner) to provide any data or information requested by the Contractor in writing that is reasonably necessary for Contractor to carry out its duties and is the Owner’s obligation to provide (so long as the Owner and any other responsible person are given adequate time to respond); or (iii) interference by the Owner or persons for whom it is responsible to the Contractor, including the Design Professional or a separate contractor hired by the Owner, with the Contractor’s performance of the Work (which continues after written notice to the Owner of such interference).
Owner Delay has the meaning provided in Section 4.4.1.
Owner Delay means any delay by Owner or GEC in performing obligations under this Agreement, which delay adversely affects Contractor’s cost, schedule or other performance under this Agreement.

Examples of Owner Delay in a sentence

  • Delay resulting from the suspension of Work pending the investigation of unforeseen concealed conditions shall be an Owner Delay, but only to the extent that the same causes actual delay in the critical path to complete the Work that satisfies all the requirements necessary to be an Owner Delay under Section 3.4.1 and all the requirements of Section 15.1.5 below.

  • CDOT shall be responsible for administering and enforcing the URAs, including, but not limited to, undertaking Reasonable Efforts to enforce Claims against Utility Owners in respect of any Unexcused Utility Owner Delay Compensation Event claimed by the Developer against the Enterprises.

Owner Delay has the meaning provided in Section 4.4.1. “Owner Security” has the meaning provided in Section 16.1.
