Oversight Costs definition

Oversight Costs means those costs, both direct and indirect, incurred by the department in implementing the voluntary cleanup program.

Oversight Costs means all costs, including but not limited to direct and indirect costs, that EPA and MassDEP and their representatives (including contractors) incur after the date of lodging of the Consent Decree in conducting the following activities: reviewing, discussing, commenting on and attending meetings related to plans, proposals, studies, or other items relating to the Work; verifying the Work; and overseeing Performing Settling Defendantsimplementation of the Work; but exclusive of, inter alia, any such costs incurred by the United States or the Commonwealth pursuant to Paragraph 9 (Notice to Successors in Title), Sections VII (Remedy Review), IX (Access and Institutional Controls), XV (Emergency Response), and Paragraph 111 of Section XXI (Work Takeover); community relations costs, enforcement support costs; record management costs; ATSDR costs; accrued Interest; or the costs incurred by the United States or the Commonwealth in enforcing the terms of this Consent Decree, including all costs incurred in connection with Dispute Resolution pursuant to Section XIX (Dispute Resolution) and all litigation costs. Oversight Costs shall not include United States Future Response Costs or State Future Response Costs.

More Definitions of Oversight Costs

Oversight Costs means all direct and indirect costs incurred by EPA or the United States after the Effective Date in monitoring and supervising Purchaser’s performance of the Work to determine whether such performance is consistent with the requirements of this Agreement, including costs incurred in reviewing plans, reports and other documents submitted pursuant to this Agreement, as well as costs incurred in overseeing implementation of the Work.
Oversight Costs means the reasonable direct and indirect costs to be incurred by the Trustees, as defined in 43 C.F.R. §11.15(a)(3), in the monitoring of the Restoration Projects contemplated by this Consent Decree. Such costs shall include reasonable administrative costs and other costs or expenses recoverable under 43 C.F.R. §11.15(a)(3) to be incurred to provide for, carry out, or support the activities or responsibilities of the Trustees consistent with this Consent Decree including their attorneys, in overseeing the implementation of the Restoration Projects.
Oversight Costs means all costs (including direct, indirect, payroll, contractor, travel, and laboratory costs) that the United States and the State incur or pay in supporting, developing, implementing, overseeing, or enforcing this Settlement, including: (1) in developing, reviewing and approving deliverables generated under this Settlement, (2) in overseeing Lessee’s performance of the Work, (3) in taking action under Paragraph 44 (Emergency Response); (4) in implementing a Work Takeover under Paragraph 76 (Work Takeover); (5) in securing, implementing, monitoring, maintaining, or enforcing the requirements of Section VIII (Property Requirements); (6) in taking action under Paragraph 94 (Access to Financial Assurance); and (7) in enforcing this Settlement, including all costs paid under Section XIV (Dispute Resolution), and all litigation costs. Oversight Costs also includes all Interest accrued on EPA’s unreimbursed costs.

Oversight Costs means the costs incurred after the Effective Date of this Consent Order and subject to the conditions provided in Section XIII (Oversight Costs). Oversight Costs include, but are not limited to, costs to: monitor response activities at the Facility; observe and comment on field activities; review and comment on submissions; collect and analyze samples; evaluate data; purchase equipment and supplies to perform monitoring activities; attend and participate in meetings; prepare and review cost reimbursement documentation; and enforce, monitor, and document compliance with this Consent Order.

Oversight costs shall include the costs of reviewing plans, reports, or other items submitted by Settling Defendants pursuant to this Consent Decree, but shall not include any costs incurred by EPA to develop plans, reports, or other items pursuant to Paragraph 40, Section XII (Submissions Requiring Agency Approval) of this Consent Decree. Oversight shall include the cost of any QA official required by EPA independent of the Supervising Contractor to conduct a QA program during the construction phase of the project. Oversight costs shall not include costs incurred by the United States or the State in performing any obligations pursuant to Section X (Access), Paragraph 91 of Section XXIV (Covenants Not to Sue by Plaintiffs), or Paragraph 53 of Section XVII (Endangerment and Future Emergency Response). Oversight costs shall also not include any costs incurred for enforcement of this Consent Decree.
