Other Security Documents definition

Other Security Documents means the Canadian Security Agreements, the Foreign Pledge Agreements, the Mortgages and each other instrument or document delivered in connection with the cash collateralization of Letters of Credit, pursuant to Section 5.08 of the Credit Agreement or otherwise to secure any of the Obligations.

Other Security Documents as used in this Note shall mean all and any of the documents other than this Note or the Security Instrument now or hereafter executed by Borrower and/or others and by or in favor of Lender, which wholly or partially secure or guarantee payment of this Note. Whenever used, the singular number shall include the plural, the plural number shall include the singular, and the words "Lender" and "Borrower" shall include their respective successors, assigns, heirs, executors and administrators. All of the terms, covenants and conditions contained in the Security Instrument and the Other Security Documents are hereby made part of this Note to the same extent and with the same force as if they were fully set forth herein.

Other Security Documents means the "Security Documents" referred to in the Other Charters;

Examples of Other Security Documents in a sentence

• Each of the representations and the warranties made by each Guarantor and Indemnitor in any Other Security Document(s) is true and correct in all material respects.

• Mortgagor hereby waives the right to assert a counterclaim, other than a mandatory or compulsory counterclaim, in any action or proceeding brought against it by Mortgagee, and waives trial by jury in any action or proceeding brought by either party hereto against the other or in any counterclaim asserted by Mortgagee against Mortgagor, or in any matters whatsoever arising out of or in any way connected with this Mortgage, the Note, any of the Other Security Documents or the Debt.

• All such costs and expenses incurred by Mortgagee together with interest thereon calculated at the Default Rate shall be deemed to constitute a portion of the Debt and be secured by this Mortgage and the Other Security Documents and shall be immediately due and payable upon demand by Mortgagee therefor.

• In the event that a claim or adjudication is made that Mortgagee has acted unreasonably or unreasonably delayed acting in any case where by law or under the Note, this Mortgage or the Other Security Documents, it has an obligation to act reasonably or promptly, Mortgagee shall not be liable for any monetary damages, and Mortgagor's remedies shall be limited to injunctive relief or declaratory judgment.

More Definitions of Other Security Documents

Other Security Documents means all and any of the documents other than this Note or the Mortgage, now or hereafter executed by Maker or others, and by or in favor of Payee, which wholly or partially secure or guarantee payment of this Note.

Other Security Documents means, the Security Documents as defined in the Disbursement Agreement, other than the Collateral Documents.

Other Security Documents means any agreement, document, instrument or deed granting, creating or evidencing any security or lien for any Other Indebtedness, including, without limitation, the "Security Documents" as defined in the Disbursement Agreement, other than the Security Documents.

Other Security Documents shall have the meaning ascribed thereto in SECTION 4.7 hereof.

Other Security Documents as used in this Note shall mean all and any of the documents other than this Note or the Security Instruments now or hereafter executed by Borrower and/or any Related Borrower and/or others and by or in favor of Lender, which wholly or partially secure or guarantee payment of this Note or any of the Related Notes, including, but not limited to, that certain Loan Agreement dated the date hereof between Borrowers, the Related Borrowers, and Lender and the Related Notes. Other Security Documents means Financial Statements of parent or subsidiary entities, credit reports or any other form of security or document review as deemed acceptable by AECO Gas Storage in its sole and unfettered discretion.

Other Security Documents means all and any of the Documents other than the Note, Lien Instrument and the Guaranty, now or hereafter executed by Borrower or others, and by or in favor of Lender, which wholly or partially secure or guarantee payment of the Note.
