Other Defendants definition

Other Defendants means all Defendants except Southfield Corporation and Xxxxxx.

Other Defendants refers to any and all defendants in this Sub-Track other than the Canary Defendants;

• Plaintiffs shall move the Court for preliminary approval of this Severed Settlement and seek approval from the Court to provide Notice of the Settlement at such time and on such schedule as Class Counsel determine is most appropriate, taking into account, inter alia, the desirability of maximizing efficiencies that may result from (a) coordinating settlements with Other Defendants and/or (b) coordinating settlements with other defendants reached in other sub-tracks in the MDL.

• Accordingly, nothing in this Agreement shall terminate Plaintiffs’ rights, if any, against Other Defendants.

• The Plaintiffs intend to use this one hundred and twenty (120) day Interim Stay period to attempt to negotiate settlements with Other Defendants consistent with the terms of this Agreement other than the Settlement Amount.

• In addition, such Plaintiffs and each of them agree that after the Effective Date they shall not settle any Debris Removal Claims with Other Defendant(s) without securing from all settling Other Defendants’ their written agreement to release all actual or alleged indemnification claims, if any, that they have against the Insureds or any of them arising out of or relating to such Other Defendant’s or Other Defendants’ settlement with such Plaintiff(s).

• In addition, to the extent that Plaintiffs who opt in to the Final Settlement Agreement or any of them are awarded judgment(s) against the Other Defendants or any of them with respect to Debris Removal Claims, such Plaintiffs agree to reduce those judgment(s) to the full extent of any and all such Other Defendants’ contribution and indemnity claims, if any, against the Insureds or any of them.

Other Defendants means Toyota Motor Sales, U.S.A., Inc., Toyota Motor Corporation, Toyota Canada Inc., American Honda Motor Company, Inc., Honda Canada Inc., Honda Motor Company, Ltd., DaimlerChrysler Corporation, DaimlerChrysler Canada Inc., DaimlerChrysler Motors Co., LLC, DaimlerChrysler Aktiengesellschaft, Nissan North America, Inc., Nissan Canada Inc., Nissan Motor Company, Ltd., Canadian Automobile Dealers’ Association, National Automobile Dealers Association, Volvo Cars of North America, LLC, Volvo Cars of Canada, Ltd., and all other persons or entities that have been, are, or may be in the future defendants in this Action, together with their respective subsidiaries, parents, affiliates,

Other Defendants refers to any and all defendants in this Sub-Track other than BAS, Bank of America Corporation, and Bank of America, N.A;

Other Defendants means persons or entities not identified on Exhibit A that are defendants in any action in which Debris Removal Claims against the Insureds or any of them are asserted, including without limitation in any Master Docket.

Other Defendants means all Defendants except the Builder’s Defendants.
