Oracle Software definition

Oracle Software means any software agent, application or tool that Oracle makes available to You for download specifically for purposes of facilitating Your access to, operation of, and/or use with, the Services.

  • The following terms apply to software and documentation provided by Oracle Corporation (“Oracle”) to the extent any Oracle software or documentation is included in or with the Licensed Products (the “Oracle Software”): Customer understands and agrees that the Oracle Software may only be used in conjunction with the Licensed Products and that Customer will not modify the Oracle Software or publish the results of any benchmark tests run on the Oracle Software.

  • Furthermore, the following additional terms and conditions apply to Your use of the Oracle Software: (i) You may not publish any results of benchmark tests run on the Oracle Software and (ii) the terms and conditions of the Uniform Computer Information Transaction Act (UCITA) are hereby expressly disclaimed and shall not have any applicability with respect to the interpretation of this License Agreement.

  • Such Oracle Software is subject to a restricted license, may not be accessed/used directly, and may only be accessed/used via the Licensed Software.

  • The Oracle Software may include source code that Oracle may provide as part of its standard shipment of such Oracle Software, and such source code shall be governed by the terms of this License Agreement.

  • To the extent permitted by applicable law, Oracle shall have no liability to You for damages, whether direct, indirect, incidental, or consequential, regarding Your use of the Oracle Software.

  • You may allow Your Users to use the Oracle Software for this purpose, and You are responsible for their compliance with the license terms.

  • PTC disclaims all warranties of any kind, express or implied, with respect to Sun Software, Oracle Software and any Bundled Third Party Products (described on the Schedule of Third Party Terms), and if any such products are supplied by PTC, they are provided without any warranties except as expressly stated in Section 2.4 hereof.

  • Your right to use Oracle Software will terminate upon the earlier of Oracle’s notice (by web posting or otherwise) or the end of these Services associated with the Oracle Software.

  • Oracle may provide You with the ability to obtain certain Oracle Software for use with the Services.

  • If Oracle provides Oracle Software to You and does not specify separate terms for such software, then such Oracle Software is provided as part of the Services and You have the non-exclusive, worldwide, limited right to use such Oracle Software, subject to the terms of these Cloud STCs and Your order (except for separately licensed elements of the Oracle Software, which separately licensed elements are governed by the applicable separate terms), solely to facilitate Your use of the Services.


More Definitions of Oracle Software

Oracle Software means any software agent, application or tool that Oracle makes available to you for download specifically for purposes of facilitating your access to, operation of, and/or use with, the Oracle cloud services. The term “partner cloud services” refers to your service offerings, any partner technology, and/or other materials that you provide to Oracle or your customers. The term “partner data” refers to all text, files, images, graphics, illustrations, information, data, audio, video, photographs and other content and material, in any format, provided by you that reside in, or run on or through, the Oracle cloud services. The term “promotional materials” refers to the pictures, screen shots, multimedia demonstrations and documentation created by you that depict or identify the connectivity and integration of the interoperating Oracle cloud services and partner cloud services. The term “proof of concept” refers to a non-production instance of the partner integration into which you have loaded the production data (or dummy data) of potential end users for the sole purpose of testing and demonstrating the effectiveness of the partner integration for a potential end user’s specific business needs. You may not use the partner integration for production purposes and you may not permit potential end users to directly access the Oracle cloud services under a proof of concept.
