Operational Software definition

Operational Software means, at any time, any software which is then being used in connection with the operation, navigation or maintenance of the Vessel.
Operational Software shall have the meaning assigned to it in -------------------- Section 5.27(a).
Operational Software means computer programs used or required on the ground to validate and control a space mission, for calibration of data derived from a space mission or for any other Agency purpose including all updates, modifications and enhancements of such programmes which (1) are developed (or are in the process of being developed), modified, enhanced or maintained by more than one party and (2) which have an expected use for the Agency’s essential purposes over a period of more than 5 years.

Operational Software means computer programs used or required on the ground to validate and control a space mission, for calibration of data derived from a space mission or for any other Agency purpose including all updates, modifications and enhancements of such programmes which (1) are developed (or are in the process of being developed), modified, enhanced or maintained by more than one party and (2) which have an expected use for the Agency’s essential purposes over a period of more than 5 years; “Participating State” means a Member or non-Member State participating in a given Agency programme according to Article V.1 (a) and (b) of the European Space Agency Convention;
Operational Software means any computer program (including, without limitation, all application software, databases, compilations, tool sets, compilers, higher level or proprietary languages, related documentation and materials, whether in source code, object code or human readable form) that is not Product Software.
Operational Software has the meaning set forth in § 5(m)(xi) below.
Operational Software means all software used by, or necessary for the operation of the business of, any of the Company Parties, including, without limitation, all software purchased or licensed from third parties ("Third Party Software") all or a portion of which is incorporated in, linked to, or necessary for the proper functioning of, or was a tool used in connection with the development of, any such Operational Software used by, or necessary to the operation of the business of, any of the Company Parties, and (ii) Applications Software shall mean all software marketed, licensed, sublicensed or otherwise distributed by any of the Company Parties to third parties, including, without limitation, all Third Party Software all or a portion of which is incorporated in, linked to, or necessary for the proper functioning of, or used as a tool in connection with the development of, any such Applications Software marketed, licensed, sublicensed or otherwise distributed by any of the Company Parties to third parties. Operational Software and Applications Software are collectively referred to as the "Company Software."
Operational Software has the meaning set forth in Section 5.13(k) below.
Operational Software the know-how and software developed by the Company that enables it to identify specific sites for deployment of Battery Technology, aspects of which are more precisely described in Schedule 5 of this Share Purchase Agreement.
Operational Software means all Computer Software used in or in connection with the business of each Acquired Entity.
