Operation Commencement Date the first Business Day after the expiry of the Development Period, by which date the Private Party shall be required, alternatively be deemed, to have commenced the conduct of the Business, as the case may be, at the Groote Xxxxxx Estate Tea Room and Restaurant in accordance with the terms and conditions of this PPP Agreement; 2.1.48 “Park Management Plan” - the management plan developed by SANParks for the Protected Area in consultation with the local authorities, organs of state and other stakeholders and approved by the Minister as provided for in the Protected Areas Act, the objective of which is to ensure the protection, conservation and management of the Protected Area in a manner which is consistent with the objectives of the Protected Areas Act and the purpose for which the Protected Area was declared a national park in terms of the Protected Areas Act; 2.1.49 “Park Manager” - the most senior manager of the Protected Area, designated as such by SANParks from time to time; 2.1.50 “Park Rules” - the Environmental rules in respect of the Protected Area, as may be revised and/or updated by SANParks from time to time; 2.1.51 “Parties” - collectively, SANParks and the Private Party;

Operation Commencement Date means the first date upon which all of the conditions precedent set forth in the Agreement shall be satisfied or waived as agreed to in writing by the Parties pursuant to the Agreement.

The Private Party recognises and acknowledges that SANParks, on the termination of this PPP Agreement after the Operation Commencement Date for whatever reason, requires continuity in the conducting of the Project.
The Private Party shall supply SANParks with an electrical certificate of compliance (CoC) within the month of the 9th anniversary of the Operation Commencement Date.
The Project shall commence on the Operation Commencement Date, and shall endure for the Project Term which is ten (10) years.
