Open Source Terms definition

Open Source Terms means any open source license which requires as part of distribution of software that the source code of such software is distributed therewith, or open source license that complies with the Open Source Definition specified at ▇▇▇.▇▇▇▇▇▇▇▇▇▇.▇▇▇ and any other comparable open source license such as for example GNU General Public License (GPL), Eclipse Public License (EPL), Apache Software License, BSD license and MIT license. “Open Source Software” shall mean any software that is licensed or distributed under Open Source Terms as specified in the Licensed Materials.
Open Source Terms means the terms of any license that require as a condition of use, modification and/or distribution of a work, the making available of source code or other materials preferred for modification, and/or the granting of permission for creating derivative works, and/or the reproduction of certain notices or license terms in derivative works or accompanying documentation, and/or the granting of a royalty-free IP license to any party.
Open Source Terms mean any open source license which requires as part of distribution of software that the source code of such software is distributed therewith or otherwise made available, or open source license that substantially complies with the Open Source definition specified at ▇▇▇.▇▇▇▇▇▇▇▇▇▇.▇▇▇ and any other comparable open source license such as for example GNU General Public License (GPL), Eclipse Public License (EPL), Apache Software License, BSD license and MIT license. Certain portions of the Licensed Software may be subject to third party license terms as expressly specified in the Licensed Software. In such event, those portions are supplied under the specified third party license terms and are not subject to the license terms of this Agreement. By installing copying, downloading, accessing or otherwise using the Licensed Software, You agree to be bound by such third party license terms with regard to those portions.

Examples of Open Source Terms in a sentence

  • You agree not to install or use the ▇▇▇▇▇▇▇▇▇.▇▇ Developer Cloud and any Licensed Materials that constitute open source software, except this restriction shall not apply if you read and comply with the Open Source Terms applicable to such open source software.

  • Except for open source software, you have no rights under this Agreement to, and may not under any circumstances use any ▇▇▇▇▇▇▇▇▇.▇▇ Developer Cloud or Licensed Materials in any manner that would, make such ▇▇▇▇▇▇▇▇▇.▇▇ Developer Cloud and Licensed Materials subject to any Open Source Terms.

  • Such open source software is not subject to the terms of this Agreement to the extent the terms of this Agreement are in conflict with the Open Source Terms applicable to such open source software.


More Definitions of Open Source Terms

Open Source Terms means the licensing conditions that require that the use, copying, modification and/or distribution of Software or any other work (“Work”) and/or any other work that is a modified version of or is a derivative work of such Work (in such case “the Derivative Work”) be subject, in whole or in part, to one or more of the following conditions: (a) where the Work or Derivative work is Software, that the Source Code automatically be made available to any third party, whether royalty-free or not; (b) that permission to create modified versions or derivative works of the Work or Derivative Work be granted to any third party; (c) that a royalty-free license relating to the Work or Derivative Work be granted to any third party that requests it. For the avoidance of doubt, licensing conditions that merely permit the possibility to apply these conditions, but do not impose any of these conditions, are not “Open Source Terms”.

Some portion of the Licensed Materials might contain Third Party Materials subject to Third Party Terms, as further specified in the Licensed Materials. Such Third Party Materials are supplied to Licensee under the applicable Third Party Terms and are not subject to the terms and conditions of this Agreement to the extent the terms and conditions of this Agreement are in conflict with such applicable Third Party Terms.
Open Source Terms means any open source license that complies with the Open Source Definition specified at ▇▇▇.▇▇▇▇▇▇▇▇▇▇.▇▇▇ and any other comparable open source license.

These actions include but are not limited to combining open source software with the ▇▇▇▇▇▇▇▇▇.▇▇ Developer Cloud or Licensed Materials by means of incorporation or linking or otherwise (including but not limited to any data, software or any other items included in Your Inputs). You agree not to install or use the ▇▇▇▇▇▇▇▇▇.▇▇ Developer Cloud and any Licensed Materials that constitute open source software, except this restriction shall not apply if you read and comply with the Open Source Terms applicable to such open source software.
