Open Source License Terms definition

Open Source License Terms means terms in any license agreement or license grant that require, as a condition of use, modification and/or distribution of a work:
Open Source License Terms means license terms that require computer code to be generally (i) disclosed in source code form to third parties; (ii) licensed to third parties for the purpose of making derivative works; or (iii) redistributable to third parties at no charge;
Open Source License Terms means any terms or conditions which meet the definition of Open Source found at xxxx://xxx.xxxxxxxxxx.xxx/docs/osd.

Examples of Open Source License Terms in a sentence

  • If any part of the Software is subject to any Open Source License Terms, as indicated by separate Open Source License Terms provided with the Software, the use and the license of that part of the Software will be subject to those Open Source License Terms.

  • In the event of any contradiction or uncertainty between the license terms contained in this Agreement and the Open Source License Terms with respect to the portions of the Software governed by Open Source License Terms, the applicable Open Source License Terms will prevail.

  • Each party warrants that it will not provide the other party with, or give third parties access through the Online Services to, computer code that is governed by Open Source License Terms, except as described above.

  • In the event of a conflict between the terms of this License and the Open Source License Terms, the Open Source License Terms shall control.

  • Neither party may use, incorporate, modify, distribute, provide access to, or combine the computer code of the other with any other computer code or intellectual property (collectively, “Provide”) in a manner that would subject the other’s computer code to Open Source License Terms.

Order Document means a quote, order confirmation and any other document(s) in writing or electronic format, provided to You by Enfocus or its authorized reseller, which sets forth the Software licensed to You under this Agreement and the Usage Restrictions applicable to that Software, if any.
Open Source License Terms means terms in any license for software that, as a condition of use, copying, modification or redistribution, require such software and/or derivative works thereof to be disclosed or distributed in source code form, to be licensed for the purpose of making derivative works, or to be distributed free of charge, including without limitation software distributed under the GPL (GNU General Public License) or LGPL (GNU Lesser Library GPL); (xiv) “Open-Source Software” means any software that contains or is derived in any manner (in whole or in part) from any software, code or libraries that are distributed as free software or as open source software or under any licensing or distribution models similar to open source, including (a) software licensed or distributed under any of the following licenses or distribution models, or licenses or distribution models similar to the following: the Artistic License, the BSD License, the Apache License, the Mozilla Public License, the GNU General Public License (GPL) or Lesser/Library GPL, or the Sun Community Source License or (b) any other license or distribution model which seeks to require any party which uses, modifies or distributes such software, code or libraries to make such software, code or libraries (or modification or derivative work thereof) or any other software, code or libraries which may be combined with or linked thereto available in source code form or which may impose any other obligation or restriction with respect to such party’s Patent or other Intellectual Property Rights; and (xv) „Malware” means any programs, subroutines, code, instructions, data or functions (including viruses, worms, malware, date bombs, time bombs, logic bombs, disabling codes or instructions, shut-down devices or code, counter devices or devices intended to collect data regarding usage or related statistics, spyware, Trojan horses, trap doors, back doors, Easter eggs, cancelbots, keys, authorization codes, or passwords) that could, be used to, (a) access, whether physically, electronically, remotely, or otherwise, (b) cease operating, or (c) damage, interrupt, interfere with or hinder the operation of or reduce or change the functionality of, any other Jabil products or services, including software or data.
Open Source License Terms means terms in any license for software that, as a condition of use, copying, modification or redistribution, require such software and/or derivative works thereof to be disclosed or distributed in source code form, to be licensed for the purpose of making derivative works, or to be distributed free of charge, including without limitation software distributed under the GPL (GNU General Public License) or LGPL (GNU Lesser General Public License).
Open Source License Terms means the licensing and/or distribution models commonly known as “open source software” or “free software” or any other licensing and/or distribution models pursuant to which software is made generally available to the public in source code form under terms that permit modification and redistribution of such software. By way of example only and without limitation, Open Source License Terms include any versions of the following agreements, licenses or distribution models: (1) the GNU General Public License (GPL); (2) Lesser/Library GPL (LGPL); (3) the Common Development and Distribution License (CDDL); (4) the Artistic License (including without limitation PERL); (5) the Netscape Public License; (6) the Sun Community Source License (SCSL) or the Sun Industry Standards License (SISL); (7) the Apache License; (8) the Common Public License; (9) the Affero GPL (AGPL); (10) the Berkeley Software Distribution (BSD); (11) the Mozilla Public License (MPL); and (12) any other licenses that are defined as OSI (Open Source Initiative) licenses as listed on the xxxxxxxxxx.xxx website.
Open Source License Terms means terms in any license, distribution model or other agreement for software, libraries, or other codes (including middleware and firmware) (a “Work”), e.g., the GNU General Public License (GPL), Lesser/Library GPL (LGPL), the Common Development and Distribution License (CDDL), and the Artistic License (including PERL), which require, as a condition of use, reproduction, modification and/or distribution of the Work or of any other software, libraries, or other code (or a portion of any of the foregoing), in each case that is incorporated into or relies on, linked to or with, derived from in any manner, or distributed with a Work (collectively, “Related Software”), any of the following: (1) the making available of source code or any information regarding the Work or any Related Software; (2) the granting of permission for creating modifications to or derivative works of the Work or any Related Software; (3) the granting of a royalty-free license, whether express, implied, by virtue of estoppel or otherwise, to any person under Intellectual Property rights (including Patents) regarding the Work alone, any Related Software alone or the Work or Related Software in combination with other hardware or software; (4) the imposition of any restrictions on future patent licensing terms, or other abridgement or restriction of the exercise or enforcement of any Intellectual Property rights through any means; (5) the obligation to include or otherwise communicate to other persons any form of acknowledgement and/or copyright notice regarding the origin of the Work or Related Software; or (6) the obligation to include disclaimer language, including warranty disclaimers and disclaimers of consequential damages.
Open Source License Terms means terms in any license for software which require, as a condition of use, modification and/or distribution of such software or other software incorporated into, incorporating, derived from or distributed with such software (a “Work”), any of the following:
