Notice to Class Members definition

Notice to Class Members means a notice to be approved by the Court, which shall be submitted to the Court substantially in the form attached hereto as Exhibit 2. The Notice may be formatted by the Claims Administrator, and it will not appear on pleading paper when ultimately mailed to Class Members.

Examples of Notice to Class Members in a sentence

  • The Settlement Administrator shall then update the entire Class Member list through the National Change of Address database (“NCOA”), before sending out Class Notice to Class Members by first-class mail.

  • Within 120 days from the Effective Date, the Settlement Administrator shall destroy all personally identifying information about any Class Member in its possession, custody, or control, including (but not limited to) any list that the Settlement Administrator received from Defendant in connection with the Settlement Administrator’s efforts to provide Notice to Class Members.

  • The Parties will submit the Settlement Agreement, the Notice to Class Members 26 and a joint stipulation regarding the class definition, see B.1, to the Court for its approval.

  • Notice to Class Members must clearly and concisely state the nature of the lawsuit and its claims and defenses, the Class certified, the Class member’s right to appear through an attorney or opt out of the Class, the time and manner for opting out, and the binding effect of a class judgment on members of the Class.

Related to Notice to Class Members

  • Class Members means all individuals in the Settlement Class, including the Class Representatives.

  • Settlement Class Members means a member of a Settlement Class.

  • Participating Class Members means all Class Members who do not submit valid

  • Settlement Class Member means a member of a Settlement Class.

  • Participating Class Member means a Class Member who does not submit a valid and timely Request for Exclusion from the Settlement.

  • Class Member means a member of the Class.

  • Class Notice means the COURT APPROVED NOTICE OF CLASS ACTION SETTLEMENT AND HEARING DATE FOR FINAL COURT APPROVAL, to be mailed to Class Members in English in the form, without material variation, attached as Exhibit A and incorporated by reference into this Agreement.

  • Non-Participating Class Member means any Class Member who opts out of the Settlement by sending the Administrator a valid and timely Request for Exclusion.

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.

  • Settlement Class Counsel means and refers to Xxxxxxxx, Xxxxxxxxxx, & XxXxxxx, P.C.

  • Claims Objection Bar Date means the deadline for objecting to a Claim, which shall be on the date that is the later of (a) 180 days after the Effective Date and (b) such other period of limitation as may be specifically fixed by the Debtors or the Reorganized Debtors, as applicable, or by an order of the Bankruptcy Court for objecting to Claims.

  • Class Member Address Search means the Administrator’s investigation and search for current Class Member mailing addresses using all reasonably available sources, methods and means including, but not limited to, the National Change of Address database, skip traces, and direct contact by the Administrator with Class Members.

  • Released Class Claims means the claims being released as described in Paragraph 6.2 below.

  • Settlement Classes means all Persons included in the Electrolytic Settlement Classes and the Film Settlement Classes.

  • Claims Objection Deadline means the later of: (a) the date that is 180 days after the Effective Date; and (b) such other date as may be fixed by the Bankruptcy Court, after notice and hearing, upon a motion Filed before the expiration of the deadline to object to Claims or Interests.

  • Class Counsel means Xxxxxx X. Xxxxxx of Xxxxxx Xxxxxx Xxxxxx LLP, Xxxx Xxxxxx Xxxxxxxxxx of Xxxxxx Xxxxxxxx LLP, and Xxxxx X. Xxxxxxxxxx of Hausfeld LLP.

  • participating class means a class of shares title to which is permitted by an Operator to be transferred by means of a relevant system;

  • Submission Deadline means 1:00 P.M., New York City time, on any Auction Date or such other time on any Auction Date as may be specified by the Auction Agent from time to time as the time by which each Broker-Dealer must submit to the Auction Agent in writing all Orders obtained by it for the Auction to be conducted on such Auction Date.

  • Election Deadline shall have the meaning set forth in Section 3.2.3.

  • Voice Initiated Election means any election concerning dividend options available to Investment Company shareholders or subscribers which is requested by voice over the telephone.

  • Notice and Claims Agent means Prime Clerk LLC.

  • Election Sign means a sign advertising or promoting the election of a political party or a candidate for public office in a federal, provincial or municipal election;

  • Ontario Settlement Class means the settlement class in respect of the Ontario Action as defined in Schedule A.

  • Objection Deadline means the date identified in the Preliminary Approval Order and Class Notice by which a Settlement Class Member must serve written objections, if any, to the Settlement to be able to object to the Settlement. The Objection Deadline shall be no later than 30 days before the Final Approval Hearing.

  • Mediation Notice is defined in Section 6.2(b).

  • Voting Members has the meaning set forth in Section 4.07(b).
