Notice of Disclaimer or Resiliation definition

Notice of Disclaimer or Resiliation means a written notice issued, either pursuant to the provisions of an agreement, under section 32 of the CCAA or otherwise, on or after the applicable Filing Date of the Participating CCAA Parties, and copied to the Monitor, advising a Person of the restructuring, disclaimer, resiliation, suspension or termination of any contract, employment agreement, lease or other agreement or arrangement of any nature whatsoever, whether written or oral, and whether such restructuring, disclaimer, resiliation, suspension or termination took place or takes place before or after the date of the Amended Claims Procedure Order;
Notice of Disclaimer or Resiliation means a written notice in any form issued on or after the Filing Date by the Respondents in accordance with the provisions of section 32 of the CCAA advising a Person of the disclaimer, resiliation or termination of any contract including any employment agreement, lease or other agreement or arrangement of any nature whatsoever, whether written or oral, and whether such disclaimer, resiliation or termination took place or takes place before or after the date of this Claims Process Order;

  • To avoid the barring and extinguishment of any Restructuring Claim you may have against the Respondents or any of the Directors or Officers, you are required to file a Proof of Claim, in the form enclosed herewith, and ensure that it is received by the Monitor by the later of: (a) the Claims Bar Date, and (b) 5:00 p.m. (Vancouver time) on the day which is twenty (20) days after the date of the Notice of Disclaimer or Resiliation sent to you (the “Restructuring Claims Bar Date”).

  • Any Notice of Disclaimer or Resiliation delivered to a Person after the Claims Process Initiation Date shall be accompanied by a Claims Package.

  • If the new entity secures capital investment, the costs of this money also need to be taken into account.

  • General Notice means any notice given in accordance with this Agreement other than a Transfer Notice;
