NO CLAIMS definition

NO CLAIMS none of the Investments is the subject of any claim, assertion, right, action or other restriction or arrangement of whatever nature which does or may impinge upon the ownership of the Investments by the Mortgagor and the Investments are and will be fully paid up;
NO CLAIMS. Agreement As noted above, in the NR12 there exists a traditional Employer and Contractor relationship with each party retaining its own rights and remedies against the other party. For example: ■ Network Rail will typically possess a right to be paid liquidated damages in the event of late completion by the Contractor; and ■ the Contractor will be obliged to indemnify Network Rail for public liability claims or breaches of statute. However, the PAA is founded on the basis that it is largely a “no claims” contract under which Network Rail and the NOPs waive many of their rights to take action against each other for events that would traditionally be a breach of contract. A small number of items are excluded from this “no claims” arrangement, including: ■ the Owner’s obligation to pay the NOPs for their work; and ■ each Participant’s liability for breaches of statute or wilful default/fraud. The reason for the “no claims” approach is again to encourage all Alliance members to focus on problem solving rather than taking legal action against each other when a problem occurs.
NO CLAIMS declaration" means the no claims declaration signed by each deal team member on the inception date.

Examples of NO CLAIMS in a sentence

  • No Claims shall be payable under this Policy unless the cause of action arises in India, unless otherwise specifically provided in Policy.

  • The Underwriters will release any such premium to the Insured after receipt of a No Claims Declaration from the Insured.

  • If this is the only payment made then your No Claims Bonus will not be affected.

  • Payments under this section will not affect your No Claims Bonus, and the maximum number of claims will not exceed two per period of insurance.

  • This insurance does not use a No Claims Bonus scale for the purposes of rate setting.

  • No Claims Officer who has an interest in the outcome of a claim may take part in the determination of that claim.

  • Prior Claims means the Competing Claims to which the Authority’s right to the Building Aid is subordinated by the School Financing Act.

  • Pending Claims shall have the meaning set forth in Section 7.1(e).
