Indenture Trustees means the Senior Notes Indenture Trustee and the Subordinated Notes Indenture Trustee.
indenture trustee or “institutional trustee” means the Trustee.
Indenture Trust Estate means all money, instruments, rights and other property that are subject or intended to be subject to the lien and security interest of the Indenture for the benefit of the Noteholders (including all Collateral Granted to the Indenture Trustee), including all proceeds thereof.
New Indenture has the meaning set forth in the Recitals.
Indenture Trustee Fee means a fee that is separately agreed to between the Master Servicer and the Indenture Trustee.
Debenture Trustee means Wilmington Trust Company, as trustee under the Indenture until a successor is appointed thereunder, and thereafter means such successor trustee.
Senior Notes Trustee means Xxxxx Fargo Bank, National Association, together with its permitted successors and assigns.
Issuer Trustees means, collectively, the Property Trustee and the Delaware Trustee.
Notes Trustee has the meaning assigned to such term in the Recitals to this Agreement.
Senior Secured Notes Trustee means U.S. Bank Trust Company, National Association, as successor in interest to U.S. Bank National Association, as trustee under the Senior Secured Notes Indenture.
Senior Noteholders means the holders of the Senior Notes.
Master Indenture means this Master Trust Indenture, as amended and supplemented from time to time in accordance with the provisions hereof.
Indenture Notes means the Notes.
Bond Trustee means the company designated as such in the preamble to these Bond Terms, or any successor, acting for and on behalf of the Bondholders in accordance with these Bond Terms.
or "Trustees means each Person who has signed this Declaration as a trustee, so long as such Person shall continue in office in accordance with the terms hereof, and all other Persons who may from time to time be duly appointed, qualified and serving as Trustees in accordance with the provisions hereof, and references herein to a Trustee or the Trustees shall refer to such Person or Persons solely in their capacity as trustees hereunder.
Collateral Trustee has the meaning set forth in the preamble.
Other Trustees Means the trustees under the Other Agreements, and any successor or other trustee appointed as provided therein.
Second Lien Notes Trustee “Second Lien Noteholder”, “High Yield Agent”, “HY Borrower”, “High Yield Creditor”, “High Yield Lender”, “Unsecured Agent”, “Unsecured Borrower”, “Unsecured Creditor”, “Unsecured Lender”, “Security Agent”, “Security Grantor”, “Senior Agent”, “Senior Arranger”, “Senior Borrower”, “Senior Creditor”, “Senior Guarantor”, “Senior Lender”, “Senior Secured Notes Guarantor”, “Senior Secured Notes Issuer”, “Senior Secured Notes Trustee”, “Senior Secured Noteholder”, “Subordinated Creditor”, “Permitted Affiliate Parent” or the “Company” shall be construed to be a reference to it in its capacity as such and not in any other capacity;
Parent Trustees means the Trustees elected or appointed pursuant to Articles 53 – 56 inclusive;
Note Trustee means the Person identified as the “Trustee” in the Indenture, solely in its capacity as Trustee pursuant to the Indenture and not in its individual capacity, or its successor in interest in such capacity, or any successor Trustee appointed as provided in the Indenture.
Owner Trustee means Wilmington Trust Company, a Delaware trust company, not in its individual capacity but solely as owner trustee under this Agreement, and any successor Owner Trustee hereunder.
NIM Trustee The trustee for the NIM Securities.
Required Noteholders has, with respect to any Series of Notes, the meaning stated in the related Series Supplement.
Owner Trustee Fee means an annual fee equal to $3,000, payable on the Payment Date occurring in June of each year, commencing in 2017.
Initial Noteholders shall have the meaning assigned to such term in the recitals.
