New Debt definition

New Debt has the meaning assigned to such term in the definition of Permitted Refinancing Indebtedness.
New Debt means debt securities in an aggregate principal amount specified in the Refunding Information.
New Debt has the meaning specified for such term in Section 16(a) of the Participation Agreement.

  • Except if otherwise provided in this Agreement, all Security created pursuant to any Secured Finance Document will be provided with first priority in respect of Secured Debt (pari passu between the Notes Debt, any New Debt and the Hedging Debt), subject to Clause 3.1 (Ranking of Secured Debt) and the other terms of this Agreement.

  • In setting the account balance, to the extent the fair market value of the Mining Assets held by TMPA exceeds any remaining System Debt or New Debt in the Mining Business, such net fair market value shall be added to the cash funds held in the account, such that the account balance is the sum of the net fair market value of the Mining Assets plus the cash funds in the account.


More Definitions of New Debt

New Debt means, collectively, the: (a) CPLV Market Debt; (b) CPLV Mezzanine Debt, if any; (c) OpCo Market Debt; (d) OpCo First Lien Term Loan, if any; (e) OpCo First Lien Notes, if any; (f) PropCo First Lien Term Loan; (g) PropCo First Lien Notes; and (h) PropCo Second Lien Notes.
New Debt means any new Financial Indebtedness incurred by the Issuer after the First Issue Date:
New Debt means the New ABL Credit Facility and the New Long-Term Debt.
New Debt means debt incurred by the Issuer as permitted under paragraph (g) in the definition "Permitted Debt".
New Debt means Financial Indebtedness incurred pursuant to item (g)(ii) of the definition of Permitted Debt.
