Neutral Evaluator definition

Neutral Evaluator means a professional engineer or a professional geologist who has completed a course of study in alternative dispute resolution designed or approved by the department for use in the neutral evaluation process, who is determined to be fair and impartial.

Neutral Evaluator means the final and binding arbiter of any dispute concerning a Class Member’s eligibility for or amount of any Claim Settlement Payment, as set forth in Sections 7.8, 7.9, and 7.10, who will be identified and retained by Defendants, with Class Counsel’s reasonable consent.

Neutral Evaluator means Hartford Superior Court Judge Xxxxxxx X. Xxxxxxx (Ret.) or any substitute neutral evaluator appointed by the Court, solely for the purpose of arbitrating disputes in accordance with Paragraph 40 of this Agreement.
Neutral Evaluator means an engineer licensed under Chapter 471, Florida Statutes, who has experience and expertise in the identification of sinkhole activity as well as other potential causes of “structural damage” or a “professional geologist”. The licensed engineer or “professional geologist” must have completed a course of study in alternative dispute resolution designed or approved by the Florida Department of Financial Services (hereinafter referred to as the “Department”) for use in the “neutral evaluation” process, must ne determined by the Department to be fair and impartial, and may not otherwise be eligible for certification under 627.7074, Florida Statutes.
