Network Security and Privacy Liability Insurance. During the term of this Contract, Supplier will maintain coverage for network security and privacy liability. The coverage may be endorsed on another form of liability coverage or written on a standalone policy. The insurance must cover claims which may arise from failure of Supplier’s security resulting in, but not limited to, computer attacks, unauthorized access, disclosure of not public data – including but not limited to, confidential or private information, transmission of a computer virus, or denial of service. Minimum limits: $2,000,000 per occurrence $2,000,000 annual aggregate Failure of Supplier to maintain the required insurance will constitute a material breach entitling Sourcewell to immediately terminate this Contract for default.

Required by OJD Not required by OJD Network Security and Privacy Liability Insurance for the duration of the Contract and for the period of time in which Contractor maintains, possesses, stores or has access to OJD data, whichever is longer, with a combined single limit of no less than $2,000,000.00 per claim or incident covering Contractor’s liability for loss, theft, unauthorized disclosure, access or use of OJD data (which may include, but is not limited to, Personally Identifiable Information (PII), Payment Card Data, and Protected Health Information (PHI)) in any format including, without limitation, hard copy format. Coverage must extend to Business Associates (if applicable) and independent contractors providing services on behalf of or at the direction of Contractor.

Lessee shall maintain cyber liability, network liability, data breach or similar privacy liability insurance covering actual or alleged acts, errors or omissions committed by Xxxxxx, its employees, contractors or agents with a limit of $2,000,000 per wrongful act/claim and $2,000,000 in the aggregate. The policy shall expressly provide, but not be limited to, coverage for the following perils: (i) unauthorized use/access of a computer system or database; (ii) defense of any regulatory action involving a breach of privacy or similar rights; (iii) failure to protect from disclosure information that is deemed confidential by law or agreement (including both personal and commercial information); and (iv) notification and remedial action costs in the event of an actual or perceived computer security or privacy breach, whether or not required by statute. Such insurance shall extend to cover damages arising out of erroneous acts, errors or omissions of any individual when acting under Xxxxxx’s supervision, direction, or control.

Exhibit C: Specifications, Duties, and Scope of Work Desired Capabilities: Maintenance/Service, repairs, and parts (excluding toners) for HP and Zebra Printers owned by Minnesota State Lottery (MSL). ). Maintenance should include but not limited to cleaning, applicable repairs, and parts replacement required to maintain each printer through the life of contract. Parts used during maintenance should include at minimal: rollers, pick up unit, and system board. Vendor must list all applicable non-consumable parts within Exhibit E: Additional Information. Service is based on an hourly rate to perform diagnostics and needed repairs/replacements outside the scope of maintenance as described above. Parts for repairs and/or replacements associated to service must be priced separately in Exhibit D: Price Schedule and listed under consumable parts on Exhibit E: Additional Information. Delivery Requirements Service/Repair/Parts on an as needed by request only basis and will be called in by the Lottery Service Desk.
