Net Realized Capital Gains definition

Net Realized Capital Gains has the meaning ascribed thereto in subsection 4.2(b) hereof;
Net Realized Capital Gains means, for any period, the amount, if any, by which the amount of the capital gains for Artis for the period exceeds the amount of any capital losses of Artis for the period determined in accordance with the Tax Act;

Examples of Net Realized Capital Gains in a sentence

  • Distributions of Net Income and Net Realized Capital Gains shall, to the extent not inconsistent with the orderly realization of the assets of the Trust, continue to be made in accordance with this Trust Agreement until the Trust has been wound up.

Net Realized Capital Gains for any Taxation Year means the amount, if any, by which the amount of the realized capital gains of the Trust for the year exceeds the aggregate of (i) any capital gains realized by the Trust in the year (including any capital gains realized by the Trust in the year on the redemption of Trust Units in specie) and designated by the Trust as payable to the redeeming Trust Unitholders pursuant to Section 6.5, (ii) the amount of any realized capital losses of the Trust for the year determined in accordance with the Tax Act; (iii) the amount determined by the Trustees in respect of any net

Net Realized Capital Gains of the Trust means, for any Taxation Year, the amount by which the “taxable capital gains” (as defined in the Tax Act) of the Trust realized in the year exceed (i) the “allowable capital losses” (as defined in the Tax Act) of the Trust realized in the year, (ii) the unapplied “net capital losses” (as defined in the Tax Act) of the Trust for preceding years of the Trust to the extent that they may be applied against taxable capital gains of the Trust for the particular year pursuant to the Tax Act, and (iii) any Trust Loss of the Trust for the year and, if the Manager so determines, any unapplied “non-capital losses” (as defined in the Tax Act) of the Trust for preceding years of the Trust to the extent they may be applied against income of the Trust for purposes of computing “taxable income” of the Trust for the particular year pursuant to the Tax Act, in each case multiplied by the reciprocal of the applicable fraction in paragraph 38(a) of the Tax Act. For these purposes, amounts referred to in this definition shall be computed in accordance with the provisions of the Tax Act;
Net Realized Capital Gains means the amount, if any, by which the aggregate of the capital gains of the Trust realized in such year exceeds the sum of:
Net Realized Capital Gains means the total of all capital gains realized by the Fund less the total of all capital losses realized by the Fund;
Net Realized Capital Gains means Realized Capital Gains minus Realized Capital Losses (but not less than zero).
