Net Award definition

Net Award means (a) the entire award payable to Landlord or Lender by reason of a Condemnation whether pursuant to a judgment or by agreement or otherwise, or (b) the entire proceeds of any insurance required under clauses (i), (ii) (to the extent payable to Landlord or Lender), (iv), (v) or (vi) of Paragraph 16(a), as the case may be, less any expenses incurred by Landlord and Lender in collecting such award or proceeds.

Net Award means (a) the entire award payable with respect to a Property by reason of a Condemnation whether pursuant to a judgment or by agreement or otherwise; or (b) the entire proceeds of any insurance required under Section 6.03 payable with respect to a Property, as the case may be, and in either case, less any Costs incurred by Lessor in collecting such award or proceeds.

Net Award means the entire award payable to Landlord or the Trustee by reason of a Condemnation, less any reasonable expenses incurred by Landlord or the Trustee in collecting such award.

Examples of Net Award in a sentence

• The term "Net Award" shall mean the total Award, less all costs, expenses and attorneys' fees incurred in the collection thereof.

• Subject to the appropriation of funds, the CITY shall use reasonable efforts to make payment of TWO HUNDRED AND FIFTY THOUSAND DOLLARS ($250,000) of the Net Award to HNI within thirty (30) days of BOE approval.

• Provided that no Event of Default has occurred and is continuing, Tenant shall be entitled to participate with Landlord and Lender in any adjustment, collection and compromise of the Net Award payable in connection with a Casualty.

• As to any such taking, the Net Award shall be deemed and distributed as Sales Proceeds under Section 5.3 hereof.

• The total Net Award made or the consideration paid or payable pursuant to such Taking (hereinafter collectively or separately referred to as the "Award"), shall be paid by whomever received to the Insurance Trustee, which shall apply the same as herein provided.

More Definitions of Net Award

Net Award means any awards or proceeds in respect of any condemnation or other eminent domain proceeding relating to any Collateral deposited in the Collateral Account pursuant to the Collateral Documents.

Net Award has the meaning assigned to that term in each Mortgage.

Net Award means (a) the entire award payable with respect to a Property by reason of a Condemnation whether pursuant to a judgment or by agreement or otherwise; or (b) the entire proceeds of any insurance required under Section 7.03 payable with respect to a Property, as the case may be, and in either case, less any Costs incurred by Landlord in collecting such award or proceeds.

Net Award shall have the meaning assigned to such term in the Mortgage and shall include any amounts received in respect of personal property pursuant to the Security Agreement or otherwise.
