DEFINITIONS In this declaration:a) “Claim” means and includes any action, suit, proceeding, claim, demand, damage, cost or expense however arising including but not limited to negligence but does not include a claim against a Motorcycling Organisation under any right expressly conferred by its constitution orregulation;b) “Indemnitees” means and includes the persons, organisations and bodies corporate whose names appear in Schedule 1.
If a body corporate, Motorcycling Australia, or Motorcycling Organisation is a party to a Tribunal hearing, one member of that body corporate, Motorcycling Australia, or Motorcycling Organisation shall be appointed by the body corporate, Motorcycling Australia, or Motorcycling Organisation to act as spokesperson for such body at the Tribunal.
Where it appears to the Tribunal that Motorcycling Australia /the Motorcycling Organisation has made an error in identifying the correct alleged breach of an Eligible Policy, or omitted alleged breaches that should have been made, the Tribunal may amend the allegation(s), subject always to the requirement that the Respondent must be informed of the new allegations and given an opportunity to respond to such allegations.
Employee means a person employed by Motorcycling Australia or a Motorcycling Organisation.
If the Respondent does dispute the Alleged Breach, the Chair will invite Motorcycling Australia /the Motorcycling Organisation to give evidence and witnesses (if any) shall be called upon to give their evidence in turn, subject to the approval of the number of witnesses to be called by the Tribunal in its discretion.
Motorcycling Australia, at its discretion, may delegate the management of the Resolution Process to another Motorcycling Organisation.
A Respondent cannot be a person or organisation that Motorcycling Australia or a Motorcycling Organisation has no jurisdiction over.
PREVAILING CONDITIONSYou acknowledge and agree that:(a) motorcycling and the Motorcycling Activities can and will be affected by the weather which may change without warning;(b) there is often an element of the "luck of the prevailing conditions" when undertaking the Motorcycling Activities over which the Motorcycling Organisation or any of them have no control;(c) unintended incidents may occur during motorcycling including defects in the track hidden.
Sport Integrity Australia may refer Complaints that fall under clauses5.1(a)(i) to (v) to Motorcycling Australia or a Motorcycling Organisation to be dealt with under the appropriate process.
Sport Integrity Australia may, in managing any part of the Complaints Process, seek any assistance from the Motorcycling Australia Complaint Manager and/or otherwise from Motorcycling Australia or a relevant Motorcycling Organisation it deems appropriate.
