Motion for Preliminary Approval is the motion to be filed by the Plaintiffs pursuant to Paragraph 37 of this Agreement, which shall be submitted to RailWorks for review and consent prior to filing. This Agreement shall be an exhibit to the Motion for Preliminary Approval.
