Mortgage Asset File definition

Mortgage Asset File. The meaning specified in the Custodial Agreement.
Mortgage Asset File. As defined in the Indenture.
Mortgage Asset File. As to each Purchased Asset, those documents listed in the applicable subsection of Section 2.01 that are required to be delivered to Custodian or which at any time come into the possession of Custodian.

  • Notwithstanding the notice periods set forth in Section 3.04, in no event shall Buyer be required to return the Mortgage Asset File related to any Purchased Asset repurchased in total by Seller prior to the later of (x) the third Business Day following the date on which Buyer and Custodian receive written notice of such repurchase request and (y) one (1) Business Day after the related Repurchase Date.

  • Except as described herein, neither the Trustee, nor any Custodian on its behalf, has made an independent examination of any documents contained in any Trustee Mortgage Asset File.

Mortgage Asset File. The meaning set forth in Section 3.3(e) hereof.
Mortgage Asset File. The meaning specified in the Custodial Agreement. “Mortgage Loan”: With respect to any Whole Loan or Senior Interest, a mortgage loan made in respect of the related Mortgaged Property.
Mortgage Asset File. With respect to any Mortgage Asset, the related Asset Documents and any additional documents required to be added to such Mortgage Asset File pursuant to the express provisions of this Agreement all of which are held by the Custodian.
Mortgage Asset File is used in this Agreement to refer to documents actually received by the Custodian, such term shall not be deemed to include such documents and instruments required to be included therein unless they are actually so received. Each of the documents referred to in Subsections 3.1(a), (b), (c) and (d) above shall be executed by all relevant Persons.
Mortgage Asset File. The meaning specified in the Custodial Agreement. “Mortgage Loan Documents”: With respect to any Whole Loan, those documents executed in connection with and/or evidencing or governing such Whole Loan, including, without limitation those that are required to be delivered to Custodian under the Custodial Agreement. “Mortgage Note”: The original executed promissory note or other evidence of the indebtedness of a Mortgagor with respect to a commercial mortgage loan. “Mortgaged Property”: The real property (including all improvements, buildings, fixtures, building equipment and personal property thereon and all additions, alterations and replacements made at any time with respect to the foregoing) and all other collateral directly or indirectly securing repayment of the debt evidenced by (a) a Mortgage Note (in the case of a Whole Loan) or (b) the Mortgage Note evidencing an interest in the Whole Loan to which such Senior Interest relates (in the case of a Senior Interest), in each case securing such Whole Loan.
