Monetary Penalty definition

Monetary Penalty means any monetary payment ordered or imposed by a court and/or agreed with, or ordered or imposed by, any other entity, whether through a judgment, order, deferred prosecution agreement, non-prosecution agreement, declination or otherwise, including, fines, penalties, restitution, forfeiture and/or disgorgement.

Monetary Penalty means the sum referenced in Section E. 1. of this Agreement.

Monetary Penalty means an amount imposed by any Commissioner under section 85, but does not include a fine imposed by any court after the trail of any offence;

Examples of Monetary Penalty in a sentence

• The Government and Epsilon agree that the Total Criminal Monetary Amount to be paid by Epsilon pursuant to this Agreement is $150,000,000, which is comprised of the following components set forth below: (1) a Criminal Monetary Penalty in amount of $22,500,000; and (2) a Victim Compensation Amount of $127,500,000.

• Each Party shall promptly notify the other Party in writing of any deviations from applicable Laws, including, each if and to the extent applicable to the respective Party or its activities hereunder, the Act, the Anti-Kickback Statute (42 U.S.C. §1320a-7b), Civil Monetary Penalty Statute (42 U.S.C. §1320a-7a), the False Claims Act (31 U.S.C. § 3729 et seq.), comparable state statutes, the regulations promulgated under all such statutes, and the regulations issued by the FDA.

• The Company and the Fraud Section and the Office agree that the Total Criminal Monetary Amount to be paid by the Company pursuant to this Agreement is $920,203,609, which is comprised of the following components set forth below: (i) a Criminal Monetary Penalty of $436,431,811; (ii) a Criminal Disgorgement Amount of $172,034,790; and (iii) a Victim Compensation Payment Amount of $311,737,008.

• The Pro Rata State Allocation of Penalty for Failure to Perform will be calculated in the same manner as the Pro Rata State Allocation of Monetary Penalty.
