Model Clauses definition

Model Clauses means the standard contractual clauses annexed to the EU Commission Decision 2010/87/EU of 5 February 2010 for the transfer of Personal Data to Processors established in third countries under the EU Directives and any amendment, replacement or renewal thereof by the European Commission.
Model Clauses means the Standard Contractual Clauses approved in Commission Decision of 5 February 2010 for the transfer of personal data to processors established in third countries, under Directive 95/46/EC (2010/87/EU) or any replacement set of clauses approved in a subsequent Commission Decision.

More Definitions of Model Clauses

Model Clauses means the standard clauses for the transfer of personal data to a processor outside of the European Economic Area in the form as adopted by the European Commission from time to time;
Model Clauses means, as applicable:
Model Clauses means the European Commission’s Standard Contractual Clauses for the transfer of Personal Data from the European Union to processors established in third countries (controller-to-processor transfers), as set out in the Annex to Commission Decision 2010/87/EU and as approved by the European Commission in the form set out in Annex A.
Model Clauses means the standard contractual clauses set out in Commission Implementing Decision (EU) 2021/914 of 4 June 2021 on standard contractual clauses for the transfer of personal data to third countries pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council (Text with EEA relevance) C/2021/3972, (or in respect of the existing transfer of personal data to processors established in third countries as applicable, it means the standard contractual clauses under Directive 95/46/EC, which are set out in Commission Decision 2010/87 of 5 February 2010), or such replacement provisions as may be issued from time to time;

Model Clauses means contractual clauses recognised by competent legislative authorities (including bodies exercising the authority to promulgate delegated legislation, and particularly in the European Union, the European Commission) for the purpose of permitting a transfer of Personal Data beyond the borders of the relevant country (for example, where the Data Controller is located within the EU Equivalent Protection Area, applicable data protection law may permit the Buyer to permit the transfer on the basis of standard contractual clauses for transfers approved by the European Commission pursuant to Articles 46.2.(c), 46.2.(d) and 46.5 of the GDPR).
