Missed Trips. Any trip where the driver arrives for the pick-up more than 30 minutes outside of the pick-up window No more than three trips in a month. The invalidity or unenforceability of any particular assessment established in this section shall not affect the validity or enforceability of other assessments established in this agreement. The city’s transit manager and contractor’s general manager will meet per mutually agreed upon schedule to review potential deficiencies. At the close of each of these meetings, a determination will be made as to what, if any, liquidated damages will be assessed. The transit manager’s decision with regard to the assessment of payment reductions is final and may not be appealed. After damages are assessed, the rate of consideration shall revert to the rates specified in the compensation section of the agreement until the next assessment is made. This program does not lessen the city’s right to declare a material breach of contract for non- compliance reasons, nor does it constitute a waiver of any other remedies provided by law. This program is in addition to, and not in lieu of, all other city remedies for failure to perform the agreement. Missed Trips means any trip which does not cover the scheduled trip length (kilometerage) between origin and destination. The trip which is either not operated or is missed due to breakdowns etc. will also be covered under the category of missed trips.

Related to Missed Trips

  • Covered Trip means scheduled trips, tours or cruises for which (a) coverage is requested: and (b) the required premium is submitted prior to the Scheduled Departure Date.
