Microsoft Software definition

Microsoft Software means the computer programs and associated documentation, including source code, used by MICROSOFT in the MICROSOFT Network or otherwise developed by or licensed to MICROSOFT.
Microsoft Software means Microsoft products provided by Interactive in accordance with the CMS SOW and these Terms. On-Prem Interactive Equipment means Interactive Equipment that is located at the Customer’s premises for use by the Customer in connection with the Services. Planned Outage Period means a period during which time the Services may not be available, or that performance of the Services may be impacted. Project means all work to be performed during the Due Diligence Stage, the Build Stage and Acceptance Testing to deliver the Solution to the Customer in accordance with this Statement of Work.
Microsoft Software means machine readable, object code versions of software provided by IM to ATMI pursuant to this Agreement (if identified in Purchase Documentation), and licensed by Microsoft Corporation to ATMI in accordance with the terms and conditions of ATMI’s end user license agreement with Microsoft.

  • Software may include or incorporate software provided by Microsoft Corporation ("Microsoft Software").

  • In addition to all other terms and conditions of this Agreement, the following applies to Your installation and use of Microsoft Software.

  • You may not: (i) sell, lease, loan, sublicense, or use the Microsoft Software for commercial software hosting services; (ii) publish any benchmark results for the Microsoft Software; (iii) work around any technical limitations in the Microsoft Software; or (iv) separate components of the Microsoft Software and install them on different pieces of equipment.

  • High Risk Use does not include utilization of the Microsoft Software for administrative purposes, to store configuration data, engineering and/or configuration tools, or other non-control applications, the failure of which would not result in death, personal injury, or severe physical or environmental damage.

  • Trimble warrants that the Software, exclusive of the Microsoft Software, will perform substantially in accordance with the accompanying written materials for a period of twelve (12) months from the date of purchase.
