Mechanical Music definition

Mechanical Music means music which is performed at Community Theatre Productions, limited to those performances that occur before and after actual performance times and during intermissions, by means other than by live performers, including, but not limited to (a) compact disc, audio record or audio tape players (but not including jukeboxes), (b) the reception and communication at the premises of radio transmissions which originate outside the premises; and which are not exempt under the Copyright Law; or (c) a music-on-hold telephone system operated by LICENSEE at the theatre premises.
Mechanical Music means music which is performed at the premises by means other than by live musicians who are performing at the premises, including, but not limited to (A) compact disc, audio record or audio tape players (but not including "jukeboxes"), (B) videotape, videodisc or DVD players; (C) performances in public rooms or guests' private rooms at the premises by means of pay or cable television, pay-per-view programming or any similar means or method (whether transmitted by satellite or otherwise to the premises); (D) the reception and communication at the premises of radio or television transmissions which originate outside the premise; and which are not exempt under the Copyright Law; or (E) a music-on-hold telephone system operated by LICENSEE at the premises.
Mechanical Music means Musical Works performed without charge to customers or viewers at the Premises (as hereinafter defined) by: (a) the reception of radio or television broadcasts and further transmission of those broadcasts over a loudspeaker or system of loudspeakers; (b) the use of Licensee’s (as distinguished from a background music service’s) audio records, tapes, discs or digital files by means of Licensee’s audio-only record, tape, disc or digital file player; or
