Matrix Common Stock definition

Matrix Common Stock means the common stock, no par value per share, of Matrix, including all shares common stock into which outstanding shares of Matrix’s preferred stock are convertible and which are issuable upon exercise outstanding warrants and options to purchase Matrix’s common stock.

  • Mingo shall be furxxxx xxxxxxx xs to amount in the aggregate to the same percentage of $15,000,000 as the percentage that such Matrix Common Shareholder's shares of Matrix Common Stock represents of all issued and outstanding shares of Matrix Common Stock (the "Indemnification Percentage"), and as to any specific matter for which a claim for indemnification is made to such Matrix Common Shareholder's Indemnification Percentage of the Damages arising out of such matter.
