Marketed Product definition

Marketed Product means a licensee's product that has its own differentiation and marketing collateral. It may comprise one price list entry, or in some cases multiple entries (for example, to account for different localizations or delivery packaging). By way of example, in terms of Oracle's product line we wouldn't consider Oracle's Java Application Server to be a Marketed Product, but Oracle's Java Application Server Platform Edition, Standard Edition, and Enterprise Edition are 3 Marketed Products. Oracle's Java Studio Enterprise is a fourth Marketed Product. All fees shall be due upon execution of this Agreement. In addition, Oracle shall have no obligation to deliver or make available the TCK until such fees are received by Oracle.
Marketed Product means the pharmaceutical preparation in finished form containing Product suitable for human administration, whether alone or in combination with other active ingredients.

In addition, Oracle shall have no obligation to deliver or make available the TCK until such fees are received by Oracle.

  • In the event that Licensee is subject to a TCK license for a JSR that Oracle has deemed to be “Related” to this JSR, for each Marketed Product that is compliant with Related JSRs, such Marketed Product will be subject to only a single royalty payment for the TCK licenses to the Related JSRs. Such single royalty payment rate shall be equal to the highest royalty rate of the TCK licenses for the applicable Related JSRs.

More Definitions of Marketed Product

Marketed Product means a Product: (a) that has received marketing approval in the applicable jurisdiction from the relevant Governmental Entity; and (b) for which commercial sales have been initiated in such jurisdiction prior to the date of execution of this CVR Agreement or for which the Company and/or its Affiliates elect, in their sole discretion, to initiate commercial sales in such jurisdiction after the date of execution of this CVR Agreement and prior to the Termination Date.
