Malfunctioning system definition

Malfunctioning system means a system which is not adequately renovating or hydraulically eliminating the wastewater it is receiving as evidenced by, but not limited to, the following conditions:• Failure of a system to accept wastewater discharge or the backup of wastewater into the structure served by the system.• Direct discharge of wastewater to the surface of the ground, surface water, or groundwater without adequate renovation.
Malfunctioning system means any subsurface sewage disposal system that exhibits a condition or conditions which, if not timely corrected, will, in the judgment of the commissioner, result in a failed system. Backflow from leaching system into septic tank, wastewater overflowing the outlet baffle, back-up into the building sewer or riser, or evidence that the system is not performing as designed, is an indication of a "malfunctioning system."
Malfunctioning system means an individual sewage disposal system which pollutes ground or surface waters or which creates a nuisance or hazard to public health or safety or the environment and includes, but is not limited to, the situations described in N.J.A.C. 7:9A-3.4.

Malfunctioning system or “failing system” means a domestic wastewater system that is not functioning in compliance with these regulations and includes, but is not limited to:
