LWDA Payment definition

LWDA Payment means the amount paid to the LWDA as its portion (75%) of the total PAGA penalties allocated to it in this Agreement and approved by the Court. “Net PAGA Amount” means the amount paid to PAGA Members as their portion (25%) of the total PAGA penalties allocated to them in this Agreement and approved by the Court.

Examples of LWDA Payment in a sentence

  • If the Court approves an LWDA Payment of less than $100,000, the remainder will be retained in the Net Settlement Amount for distribution to Participating Class Members.

  • Assuming the Service Award is $15,000, the Class Counsel Fees and Costs Award is $1,293,333, the Settlement Administration Costs are $9,000, and the PAGA LWDA Payment is $7,500, then the Net Settlement Amount shall be $2,525,167.

  • If the Court approves an LWDA Payment of less than $37,500, the remainder will be retained in the Net Settlement Amount.

  • If the approved amount of the LWDA Payment is more than 10% above the agreed upon amount, or more than 10% below the agreed upon amount, the Parties agree to further confer and attempt to negotiate a resolution prior to the abrogation of this Agreement.

  • If the Superior Court approves an LWDA Payment of less than $15,000, the remainder will be retained in the Net Settlement Amount for distribution to Participating Class Members on a pro rata basis.
