LTD DOCA definition

LTD DOCA means the deed of company arrangement entered into between, inter alia, LTD, the LTD Deed Administrators and the LTD Administrators on or about the date of this Deed, in the form set out at Schedule 3 (LTD DOCA);
LTD DOCA means the deed of company arrangement executed by NMC Healthcare Ltd (in administration) (subject to deed of company arrangement) pursuant to Chapter 8 of Part 1 of the Insolvency Regulations for the purpose of implementing the Restructuring.
LTD DOCA means the deed of company arrangement by among others LTD and Holdco;

Examples of LTD DOCA in a sentence

  • Deed Company Claims shall be dealt with for all purposes in accordance with Clause 6 (Claims Determination Process) of the LTD DOCA and any related provisions of that DOCA notwithstanding that those claims are against the Deed Company, not LTD.

  • In exchange for the assignment in Clause 9(a) above, Deed Company Creditors shall be entitled to receive Post-Restructuring Litigation Recoveries pursuant to clauses 11 (Litigation Undertaking) and 12 (Post-Restructuring Litigation Recoveries) of the LTD DOCA (including the Litigation Undertaking).

  • The LTD Administrators may, in their absolute discretion, pursue the Assigned Claims in connection with Clause 11 (Litigation Undertaking) of the LTD DOCA .

  • AFF Financiers shall be dealt with for all purposes in accordance with clauses 8.4 (Calculation of AFF Reorganisation Entitlements) and 9.8 (Distribution of AFF Reorganisation Entitlements) of the LTD DOCA and any related provisions of that DOCA, even if the relevant AFF Rolled Up Election related to a claim against the Deed Company, not LTD.

  • All Group Company Creditors must complete the relevant Schedules to this Admitted Group Creditor Letter in order to receive and make certain elections in respect of DOCA Creditor Entitlements (subject to the Claims Determination Process established pursuant to the LTD DOCA).

  • The releases contained in this deed of release shall replicate the releases set out in the applicable LTD DOCA and each Related DOCA and will take effect following the occurrence of the Restructuring Effective Date.

  • Prior to completing this Admitted Group Creditor Letter, Group Company Creditors are encouraged to read the Revised Administrators’ Proposals, the LTD DOCA, and (if relevant) the Related DOCAs.

  • At the time specified in the Restructuring Implementation Deed, each Demand Creditor irrevocably and unconditionally assigns all of its rights, title and interests in their Deed Company Claim(s) to Holdco in exchange for the rights and interests granted to it pursuant to clauses 8 (Entitlements) and 9 (Distribution of entitlements) of the LTD DOCA.
