Limitations on Actions. Notwithstanding any applicable law that may provide for a longer period of time, no action, regardless of its form and including if the action involves nonpayment, arising out of this Agreement may be brought by either party more than four (4) years after the party first becomes aware of the facts upon which a cause of action arises.

The amount of tax shall be reduced by the present value of the tax benefits to be obtained by depreciating the property in determining the tax liability.
