Notwithstanding anything to the contrary set forth herein, all items or components of the Project with respect to which no Material Defects are identified in a timely Non-Compliance Notice shall be deemed to be accepted by City, subject to Latent Defects.
Nothing in this clause shall derogate from the Supplier’s liability for Latent Defects during the Latent Defects Liability Period.
The Contractor shall be liable for the costs of rectification of any Latent Defect in and/or damage caused to the Works as a result of such Latent Defect which is notified to the Contractor and which may appear or occur during the Latent Defects Rectification Period.

Such inspection, if made will be in addition to any inspection, examination or testing to be carried out by the Supplier in terms of the Contract and shall not release the Supplier from any obligation under the Contract nor be construed as an admission that the Goods are free of any patent or Latent Defects.
