JAMS Arbitrator definition

JAMS Arbitrator shall have the meanings set forth in Section 14(k) of this Agreement.
JAMS Arbitrator shall have the meaning set forth in Section 16.11(c).
JAMS Arbitrator has the meaning set forth in Section 10(o)(iii) above.

  • At the request of JAMS the parties involved in the dispute shall meet with JAMS at its offices within ten (10) calendar days of such request to discuss the dispute and the qualifications and experience which each party respectively believes the JAMS Arbitrator should have; provided, however, the selection of the JAMS Arbitrator shall be the exclusive decision of JAMS and shall be made within thirty (30) days of the written application to JAMS.

  • Each party shall nominate within ten days of filing of the notice of arbitration a JAMS arbitrator and such JAMS arbitrators shall select within seven days a third JAMS Arbitrator who shall be the sole Arbitrator to resolve such dispute (the “Arbitrator”).

  • If any party fails to appear at a duly scheduled and noticed hearing, the JAMS Arbitrator is hereby expressly authorized to enter judgment for the appearing party.

  • The JAMS Arbitrator will consider only the specific issues submitted to him/her for resolution, and will be directed to make a determination as to the “successful” party or a specific determination that there is no prevailing party.

  • Arbitrators has the meaning set forth in Section 11.5.3.

  • JAMS means JAMS, Inc. or its successor entity, a judicial arbitration and mediation service.

  • Arbitrator means the authority nominated by Chief General Manager (CGM) for arbitration.

  • Arbitration means any arbitration whether or not administered by a permanent arbitral institution;

  • Arbitration Board has the meaning set forth in Section 9.10.

  • Accounting Arbitrator has the meaning set forth in Section 2.6(c).

  • Arbitration Panel shall have the meaning set forth in Section 3 hereof.

  • Notice of Arbitration means the formal notice from the CONTRACTOR or the CUSTOMER to the other party referring a dispute to arbitration in accordance with the provisions of Schedule 2-9.

  • Mediator means an individual who conducts a mediation.

  • Mediation means any process in which a mediator facilitates communication and negotiation between the parties to assist them in reaching a voluntary agreement regarding their dispute.

  • Arbitration Tribunal means an organ composed of an odd number of persons known as arbitrators, who decide on the solution of a conflict in which the parties have expressly waived recourse to the ordinary civil courts

  • ICC Rules means the Rules of Arbitration of the International Chamber of Commerce in effect on the date the applicable arbitration proceeding begins.

  • UNCITRAL Arbitration Rules means the arbitration rules of the United Nations Commission on International Trade Law.

  • AAA Rules has the meaning set forth in Section 11.2.

  • Arbitrable Dispute means any dispute arising under or in connection with this Agreement.

  • Panel means the Panel on Takeovers and Mergers;

  • Referee means a person who is designated as a referee under the friend of the court act.

  • Arbitration Award shall have the meaning given such term in Section 22.5.

  • Neutral ’ means an individual who, with respect to an issue in controversy, functions specifically to aid the parties in resolving the controversy;

  • JAMS Rules has the meaning assigned thereto in Section 13 hereof.

  • Arbiter has the meaning set forth in Section 2.3(c).

  • Dispute Board (DB) means the person or persons named as such in the SCC appointed by agreement between the Procuring Entity and the Contractor to make a decision with respect to any dispute or difference between the Procuring Entity and the Contractor referred to him or her by the Parties pursuant to GCC Sub-Clause 46.1 (Dispute Board) hereof.

  • Arbitration Rules means the AAA’s Commercial Arbitration Rules and Mediation Procedures.

  • Alternative dispute resolution means mediation, arbitration, conciliation, or other nonjudicial procedure that involves a neutral party in the decisionmaking process. The form of alternative dispute resolution chosen pursuant to this article may be binding or nonbinding, with the voluntary consent of the parties.

  • AAA means the American Arbitration Association.
