IT Products and Services definition

IT Products and Services means the goods and services that the Contractor makes available for customers. Lot – a category grouping within a Framework Agreement that varying suppliers have been appointed to Managed Service - a strategic practice associated with transferring day-to-day management responsibility for the conduct of a business stream including the delivery of associated outputs to a supplier. In the public sector this term is generally used to describe the transfer of an end-to-end function, currently carried out in-house, to a non-public sector organisation, in other words outsourcing. It implies the transfer of significant responsibility and risk to a contractor who in turn has considerable leeway in how to satisfy the contract. Model Contract – the terms and conditions that have been constructed by Government Procurement Service and forms part of the Commoditised IT Hardware and Software Framework Agreement between Government Procurement Service and each Contractor. The Model Contract forms the basis of your Contract with the Contractor. Model Order Form – the order form set out in Annex B of this Schedule. Most Economically Advantageous Tender – the tender which is most economically advantageous to you. The UK Public Contract Regulations 2006 state that you “shall use criteria linked to the subject matter of the contract to determine that an offer is the most economically advantageous including quality, price, technical merit, aesthetic and functional characteristics, environmental characteristics, running costs, cost effectiveness, after sales service, technical assistance, delivery date and delivery period and period of completion.” The mandatory high level criteria for each Lot are set out in Clause 2.5 of this Schedule. Order – an order for IT products and services served by you on the Contractor. Schedule – a section of the Model Contract. Special Terms – are those proposed by you to be included in the resultant contract. Such terms must not substantially modify the Model Contract. Sub-contractors – any supplier selected, appointed and managed by the Contractor. You do not have a direct contractual relationship with the Sub-contractor following the placing of an Order / Contract through the Commoditised IT Hardware and Software Framework Agreement. Terms and Conditions – general and special arrangements, provisions, requirements, rules, specifications, and standards that form an integral part of an agreement or contract.

Related to IT Products and Services
