Notwithstanding any prior acceptance of vessel by Seller, if at any time prior to the passing of risk and title the vessel ceases to comply with the requirements of the ISPS Code: a) Seller shall have the right not to berth such nominated vessel and any demurrage resulting shall not be for the account of the Seller.
