Irreparable Damage definition

Irreparable Damage means any action undertaken by a person, as defined in this Ordinance, foreseeably leading to the death or permanent Injury of the Heritage tree, or which places the tree in a hazardous condition or an irreversible state of decline within one year from when action was taken. This includes, but is not limited to, Cutting, topping, girdling, poisoning, trenching or excavating within the Tree Protection Zone (TPZ), altering the grade, paving in excess of fifty percent (50%) of the Dripline, excessive watering of oak trees, and Excessive Pruning.

Irreparable Damage means damage that is caused to a covered Leased Item that renders the Leased Item incapable of being restored to its original condition.
