Involuntary Proceeding means a child custody proceeding in which the parent does not consent of the parent’s free will to the foster care, preadoptive, or adoptive placement or termination of parental rights or in which the parent consents to the foster care, preadoptive, or adoptive placement under threat of removal of the child by a state court or agency. 25 C.F.R. § 23.2.

Involuntary Proceeding means any of the following instituted against a party by any other person or entity: (i) assignment for the benefit of creditors, (ii) proceeding seeking relief under any federal or state bankruptcy or insolvency laws, or (iii) proceeding seeking the appointment of a receiver, trustee, custodian or similar official for such party’s business or assets.

Involuntary Proceeding shall have the meaning set forth in Section 10.1(g) hereof.

Involuntary Proceeding means the commencement of a proceeding or case by any party other than Lender in any court having jurisdiction, seeking (i) relief in respect of Borrower in an involuntary case or other similar proceeding under any federal or state bankruptcy, insolvency or other similar law now or hereafter in effect or (ii) the appointment of a trustee, receiver, liquidator, custodian or other similar official for Borrower or for any substantial part of the property of Borrower, in each case without the consent of Borrower.
