Access by a Partner to NASA facilities or property, or to a NASA Information Technology (IT) system or application, is contingent upon compliance with NASA security and safety policies and guidelines including, but not limited to, standards on badging, credentials, and facility and IT system/application access, including use of Interconnection Security Agreements (ISAs), when applicable.
Force Majeure events shall include, but shall not be limited to, acts of terrorism, strikes, labor troubles required maintenance work, inability to access the local distribution utility system, sabotage, acts of God, pandemics, changes in law, rules, or regulations or other acts of governmental authority, and events beyond Think’s control occurring with respect to the EDU, PJM Interconnection LLC, or other third-party systems or assets.
To the extent that complete terms, conditions and/or rates for any Interconnection Service are not contained in this Agreement at the time CLEC seeks to order such services, the Parties shall amend this Agreement to include such terms, conditions and rates prior to CLEC submitting such order.
Except where expressly permitted elsewhere in this Agreement, notwithstanding the availability of Interconnection Services under tariffs in some AT&T-21STATE incumbent ILEC states, CLEC agrees that any purchase of Interconnection Services addressed by this Agreement or required to be offered by AT&T-21STATE under Section 251 of the Act, shall be purchased solely pursuant to the terms, condition and rates set forth in this Agreement.
This Agreement is the arrangement under which the Parties may purchase from each other Interconnection Services.
