Hosting Agreement definition

Hosting Agreement means an agreement concluded between the Joint Undertaking and the hosting entity of a pre-exascale supercomputer or between the Joint Undertaking, the other co-owners of a petascale supercomputer and the hosting entity of a petascale supercomputer, which may take the form of a service contract or other contract;

• If a third party claims that any portion of the products or services provided by Vendor under the terms of the Contract or this Hosting Agreement infringes that party’s patent or copyright, Vendor shall defend and indemnify the State of Oklahoma and Customer against the claim at Vendor’s expense and pay all related costs, damages, and attorney’s fees incurred by or assessed to, the State of Oklahoma and/or Customer.
