Examples of Holders in a sentence
The terms of the Notes, and the respective rights thereunder of the Company, the Trustee and the Holders of the Notes, include those stated in the Indenture and those made part of the Indenture by reference to the mandatory provisions of the TIA, and Holders are referred to the Indenture and the TIA for a statement thereof and for the definitions of capitalized terms used but not defined herein.
Any and all notices or other communications or deliveries to be provided by the Holders hereunder including, without limitation, any Notice of Exercise, shall be in writing and delivered personally, by e-mail, or sent by a nationally recognized overnight courier service, addressed to the Company, at 000 Xxxxx Xxxxx Xxxxxx, Xxxxx 000, Xxxxxxxxx: Xxxxxxxx Xxxxxxxx, email address: ****, or such other email address or address as the Company may specify for such purposes by notice to the Holders.
Except as otherwise provided herein, the provisions of this Warrant may be amended and the Company may take any action herein prohibited, or omit to perform any act herein required to be performed by it, only if the Company has obtained the written consent of the Required Holders.
The Company may fix in advance a record date for the determination of Holders who are entitled to vote at a meeting called pursuant to Section 15.02 and, if the Company does not so fix a record date, the Trustee may do so.
In the absence of a quorum within one hour of the time appointed for any such meeting, the meeting shall, if convened at the request of Holders of Bonds of such series and Tranches, be dissolved.
