Examples of Holder or other person in a sentence
Notwithstanding General Condition 11(a) and/or General Condition 11(b), none of the Issuer, the Calculation Agent nor any Agent shall be liable to any Holder or other person for any commissions, costs, losses or expenses in relation to or resulting from the transfer of euro or any currency conversion or rounding effected in connection therewith.
The Company shall account to the Holder or other person entitled to such share for the net proceeds of such sale by carrying all moneys in respect thereof to a separate account which shall be a permanent debt of the Company and the Company shall be deemed to be a debtor and not a trustee in respect thereof for such Holder or other person.
Any joint Holder or other person jointly entitled to a share as aforesaid may give receipts for any dividend or other moneys payable in respect of the share.
Neither the Depositary nor the Company shall be under any obligation to appear in, prosecute or defend any action, suit, or other proceeding in respect of any Deposited Securities or in respect of the American Depositary Shares, on behalf of any Owner or Holder or other person.
No interest shall be payable to such Holder or other person in respect of such moneys and the Company shall not be required to account for any money earned on them.
The Directors may give any number of Disclosure Notices pursuant to paragraph (b) to the same Holder or other person in respect of the same share.
If there is an offer to acquire all Westpac SFIs in a Series, neither Westpac nor the Security Trustee is obliged to respond to the offer but may direct the Security Trustee to take such Reasonable Action as it may be advised and shall not be liable to any Holder or other person for taking Reasonable Action.
The Depositary shall have no obligation to appear in, prosecute or defend any action, suit, or other proceeding in respect of any Deposited Securities or in respect of the American Depositary Shares, on behalf of any Owner or Holder or other person.
Exercise Notice means a notice in the form of Appendix 2 given by the Holder or other person entitled to give such a notice to Citi in respect of a CitiFirst Warrant in accordance with clause 4 of the Terms of Issue.Exercise Period means: (a) in the case of American Style CitiFirst Warrants, the period beginning on the day the CitiFirst Warrants commence trading on ASX, and ending on and including the Relevant Expiry Date; or(b) in the case of European Style CitiFirst Warrants, the Relevant Expiry Date.
