Examples of HITECH Standards in a sentence
Any ambiguity in this Agreement shall be resolved in favor of a meaning that permits Covered Entity to comply with applicable law protecting the privacy, security and confidentiality of Protected Health Information, including, but not limited to, HIPAA, the HIPAA Regulations and the HITECH Standards.
Covered Entity possesses or may possess identifiable health information which is subject to HIPAA, the HIPAA Regulations, and/or the HITECH Standards.
Covered Entity shall not request Business Associate to use or disclose Protected Health Information in any manner that would not be permissible under HIPAA, the HIPAA Regulations and the HITECH Standards if done by Covered Entity or that is not otherwise expressly permitted under Section 4 of this Agreement.
Business Associate hereby acknowledges and agrees that Covered Entity is a covered entity and that Business Associate is a business associate of Covered Entity under HIPAA, the HIPAA Regulations and the HITECH Standards.
Except as otherwise limited in this Agreement, Business Associate may use or disclose Protected Health Information on behalf of, or to provide services to, Covered Entity in connection with the performance of the services if such use or disclosure of Protected Health Information would not violate HIPAA, the HIPAA Regulations or the HITECH Standards if done by Covered Entity or such use or disclosure is expressly permitted under Section 4.b. of this Agreement.
Terms used, but not otherwise defined, in this Agreement shall have the same meaning as those terms in the HIPAA Rules (as defined below), the HITECH Standards (as defined below) or any future regulations promulgated or guidance issued by the Secretary (as defined below) thereunder.
The parties acknowledge that the foregoing provisions are designed to comply with the mandates of the Privacy and Security Rules and the HITECH Standards.
A reference in this Agreement to a section in HIPAA, the HIPAA Regulations or the HITECH Standards means the section as in effect or as amended from time to time, and for which compliance is required.
