Hazardous or Toxic Materials definition

Hazardous or Toxic Materials as used in this Lease shall mean those materials identified in The Comprehensive Environmental Response, Compensation and Liability Act of 1980 of the United States Code and by the laws of the Commonwealth of Virginia, as such sections may be amended from time to time;
Hazardous or Toxic Materials includes but is not limited to (i) materials defined as "Hazardous Waste" under the Federal Resource Conservation and Recovery Act and similar state laws, and (ii) "hazardous substances" as identified under the Federal Comprehensive Environmental Response, Compensation and Liability Act and especially in CERCLA 101(14) and as set forth in Title 40, Code of Federal Regulations, Part 302, and (iii) those elements or compounds which are contained in the list of hazardous substances adopted by the United States Environmental Protection Agency (EPA) and the list of toxic pollutants designated by Congress or the EPA or defined by any Federal, state or local statute, law, ordinance, code, rule, regulation, order or decree regulating, relating to, or imposing liability or standards of conduct concerning, any hazardous, toxic, polluting, or dangerous waste, substance or material, as such lists are now or at any time hereafter in effect, and (iv) asbestos, and (v) radon, and (vi) polychlorinated biphenyls, and (vii) petroleum products, and (viii) such other materials, substances or waste which are otherwise dangerous, hazardous, harmful or deleterious to human, plant or animal health or well being.
Hazardous or Toxic Materials means any chemicals, gasses, solids, liquids, and any other materials or substances that pose a present or potential hazard to human health or safety or the environment.

More Definitions of Hazardous or Toxic Materials

Hazardous or Toxic Materials means asbestos, lead, silica dust, toxic dust, “fungi”, bacteria, organic pathogens, bio-organic growth or systemic chemical poison.
Hazardous or Toxic Materials means oil or petrochemical products, PCBs, asbestos, urea formaldehyde, flammable explosives, radioactive materials, hazardous wastes, toxic substances or related materials, including, without limitation, any substances defined from time to time as or included in the definition of "hazardous substances," "hazardous materials," or "toxic substances" under any applicable federal, state or local laws or regulations.
Hazardous or Toxic Materials means any substance or material which is (i) designated, defined, classified or regulated as a hazardous substance, hazardous material, hazardous waste, pollutant or contaminant under any Applicable Laws, as currently in effect as of the date of this Agreement, (ii) petroleum hydrocarbon, including crude oil or any fraction thereof and all petroleum products or materials and substances containing petroleum or other hydrocarbons, (iii) PCBs, (iv) lead, (v) friable asbestos, (vi) flammable explosives, (vii) infectious materials or (viii) radioactive materials.
Hazardous or Toxic Materials means (i) asbestos or any material composed of or containing asbestos in any form and in any type; (ii) any petroleum-containing substance or material; or (iii) any hazardous, toxic or dangerous waste, contaminant, pollutant, substance, material, smoke, gas or particulate matter, as from time to time defined by or for purposes of any Federal, state or local environmental, health or safety, ordinance, code, rule, regulation, order or decree regulating, relating to or imposing liability or standards concerning or in connection with hazardous, toxic or dangerous wastes, substances, material, gas or particulate matter. Commencing with Peoples obtaining Closure from the USEPA comprising the Subject Property, except to the extent of any damages caused by the negligence or willful misconduct of Peoples and the Peoples’ Indemnified Parties, Grantee, on behalf of itself and on behalf of entities owned or controlled, in whole or in part, by Grantee and on behalf of Grantee’s and their successors and assigns, and Grantee’s and their respective successors in title to the Subject Property, (collectively the “Grantee Indemnifying Parties”) covenants and hereby agrees to comply with the terms of the USEPA Closure and NFR Letter, if any, including without limitation maintaining the institutional controls and engineered barriers therein, and defend, indemnify, and hold harmless Peoples and Peoples’ Indemnified Parties from any and all Claims, loss or damages, of every kind and nature, and reasonable attorneys’ fees and court costs (collectively, “Loss”), arising out of or in connection with Grantee, Grantee’s contractors’ or invitees’ breach of this Agreement or negligent act or omissions or the presence of Hazardous or Toxic Materials on the Subject Property, or failure to maintain any institutional controls or engineered barriers required under any NFR Letter or USEPA Closure document pertaining to the Subject Property or breach of this Agreement provided, however, the aforesaid indemnification shall exclude claims for bodily injury and property damage against the Peoples’ Indemnified Parties relating to exposure to pollution conditions at, on or under the Subject Property on or prior to the date of this special warranty deed or for claims that MGP constituents or other Hazardous or Toxic Materials that existed on the Subject Property on or prior to USEPA Closure migrated from the Subject Property to offsite properties including the Chicago River. Hazardous or Toxic Materials means all materials, substances, wastes and chemicals classified, defined, listed or regulated as, or containing, a “hazardous substance,” “hazardous waste,” “toxic substance.” “pollutant,” “contaminant,” “oil,” “hazardous material.” solid waste,” and/or “regulated substance” under any Environmental Law. As used herein, the termEnvironmental Laws” shall mean any and all statutes, rules, regulations, ordinances, orders, permits, licenses, and other applicable legal requirements, relating directly or indirectly to human health or safety or the environment, or the presence, handling, treatment, storage, disposal, recycling, reporting, remediation, investigation, or monitoring of hazardous or toxic materials.
Hazardous or Toxic Materials means any hazardous substance, hazardous material or toxic substance, as defined in the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (“CERCLA”), the Resource Conservation and Recovery Act, as amended (“RCRA”), the Toxic Substances Control Act, as amended (“TSCA”), including, but not limited to petroleum products and by-products, asbestos, formaldehyde, radioactive substances, hydrocarbons, industrial solvents, flammables and explosives or any other substance or material which would constitute or cause a health, safety or environmental hazard on or in the vicinity of the Premises or require remediation at the behest of any governmental agency.
Hazardous or Toxic Materials include (i) "hazardous waste" under the Federal Resource Conservation and Recovery Act and similar state laws; (ii) "hazardous substances" under the Federal Comprehensive Environmental Response, Compensation and Liability Act ("CERCLA") and similar state laws, and (iii) "regulated substances" under Subchapter IX of the Federal Solid Waste Disposal Act and similar state laws. Examples of Hazardous or Toxic Materials include (but are not limited to) those "hazardous wastes" "hazardous substances" and "regulated substances," whether solid, semi-solid, liquid or gaseous that are toxic, ignitable, corrosive, carcinogenic, or similarly dangerous to human, plant or animal health and well being, including radon, asbestos, paints, solvents, chemicals, petroleum products, batteries, transformers, and other discarded manmade materials with hazardous or toxic characteristics. Notwithstanding the foregoing, "Hazardous or Toxic Materials" shall not include (i) reasonable quantities of petroleum or chemical products or other materials or substances, in whatever form, kept until used in proper storage containers, that are used in construction on the Mortgaged Property or in the ordinary course of business of Mortgagor or any of its tenants, or (ii) the waste products from such products, materials or substances.
