Future Service Provider definition

Future Service Provider means any service provider who shall provide any services equivalent to the Partnering Services immediately after termination or expiry of this Agreement or suspension of exclusivity in respect of such Partnering Services;

Future Service Provider has the meaning given to it in Clause 28.12.4 (Indemnities);

Future Service Provider means any third party provider of the Works who replaces Supplier.

• The Supplier shall indemnify and keep the Authority indemnified in full against all Direct Losses, incurred by the Authority or any Future Service Provider as a result of or in connection with any failure on the part of the Supplier to comply with this clause and/or the relevant Subcontractor’s failure to comply with such terms.

• No term of this Agreement is enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to this Agreement except clauses 29.5, 29.6.4(a), 29.7.2(b), 29.7.3, 29.8.1(b) and 29.10 which shall be enforceable by a Future Service Provider in the case where the Authority has assigned the benefit of such clauses pursuant to clause 29.9.2 of this Agreement.

Future Service Provider each and every service provider who shall provide any service equivalent to any of the Services immediately after expiry or earlier termination of this Agreement;
