Force Maieure definition

Force Maieure means an event or circumstance arising outside of the reasonable control of a party, such as any act of God, flood, natural disaster, embargo, acts of civil or military authorities, terrorism, labor strikes, governmental embargos, and governmental orders.

Force Maieure means war, riots, insurrections, fIre, explosions, sabotage, strikes, and other labor or industrial disturbances, acts of God or the elements, Governmental Requirements, disruption or breakdown of production or transportation facilities, delays of pipeline carrier in receiving and delivering crude oil tendered, or any other cause, whether similar or not, reasonably beyond the control of the affected Party.

Force Maieure means (i) strikes, lockouts or labor disputes, (ii) the inability through no fault of Seller to obtain labor or materials or reasonable substitutes therefor, (iii) acts of God and adverse weather conditions, (iv) enemy or hostile governmental action or acts of terrorism, (v) governmental restrictions such as embargoes, (vi) civil commotion, (vii) fire or other casualty or (viii) other conditions similar to those enumerated above that are beyond the reasonable control of Seller, but in each case excluding any such events or conditions that merely result in increased costs to Seller.

• Force Maieure, Neither patty shall be responsible for any failure to pafotm due to unforeseen, non-commercial circumstances beyond its reasonable control, including but not limited to acts of Ood, war, riot, embargoes, acts of civil or military authorities, fire, floods, earthquakes, blackouts, accidents, or strikes.

• Upon a termination pursuant to the preceding sentence or pursuant to a Force Maieure event.

More Definitions of Force Maieure

Force Maieure means any event which: (i) causes either party to be unable to perform under this agreement; and (ii) is outside the reasonable control of the party unable to perform and could not be avoided by such party through the exercise ofdue care. Force Majeure events include, without limitation: terrorists, earthquakes, fires, floods, tornadoes, wars, labor strikes or similar accidents, disputes or events.

Force Maieure means an event that is beyond the control of the Party affected including but not limited to any act of God, failure of contractors or suppliers of materials, act of the public enemy, invasion, insurrection, ice, explosion, breakage or accident to machinery or equipment, flood, earthquake, tornado, storm, fire, lightning, epidemic, war, riots, civil disturbance or disobedience, labor dispute, material shortage, sabotage, terrorist activity, restraint, curtailment, order, regulation or restriction imposed by court order, governmental, military or lawfully established civilian authorities, emergency circumstances upon the property or equipment of PJM, and action or non-action by or inability to obtain the necessary authorization or approvals from any governmental agency or authority, which by exercise of due diligence such Party has been unable to overcome. Force Majeure shall not include economic hardship.

Force Maieure means events beyond the control of the parties, including, without limitation, fire, flood, tornado, or earthquake, war, riot, insurrection, strike, lockout, boycott or embargo, acts of God, unavoidable casualties, labor disputes, and unusual delays in transportation, unavailability of materials, adverse weather conditions not reasonably anticipatable. Any party who asserts the occurrence of force majeure shall give written notice within five (5) business days after the commencement of a delay caused by an event of force majeure. and any party making claim therefor shall give a supplemental notice of the period of time such delay caused by an event of force majeure is expected to last otherwise any right of claim therefor shall be deemed waived.

Force Maieure means a delay due to acts of God, governmental restrictions, stays, judgments, orders, decrees, enemy actions, civil commotion, fire, casualty, strikes, work stoppage, shortages of labor or materials or similar causes beyond the reasonable control of Borrower; provided that (1) any period of Force Majeure shall apply only to performance of the obligations necessarily affected by such circumstance and shall continue only so long as Borrower is continuously and diligently using all reasonable efforts to minimize the effect and duration thereof; and (2) Force Majeure shall not include the unavailability or insufficiency of funds.

Force Maieure means any event or occurrence not within the control of the party claiming Force Majeure and which by the exercise of reasonable diligence such party is unable to prevent or overcome, Lcluding, without limiting the generality of the foregoing, any act of God, strikes, lockouts, or other industrial disturbances (and provided strikes, lockouts and other industrial disturbances will be deemed not to be within the control of the party claiming Force Majeure or able to be prevented or overcome by such party where acceding to the demands of opposing persons is inadvisable in the discretion of the party), sabotage, wars, blockades, insurrections, riots, epidemics, landslides, lightning, earthquakes, floods, storms, fires, washouts, arrests, restraints of rulers and peoples, civil disturbances, explosions, breakages or accidents to machinery, the inability to obtain materials or equipment, the inability to obtain or the withdrawal or termination of permits, orders, licences, certificates or other authorizations, and - the order or direction of any court, board or governmental or regulatory authority having jurisdiction, but excludes any lack of funds or financing, lack of credit, or other financial reason;

Force Maieure means any event the occurrence of which prevents or delays the performance by Landlord or Tenant of any obligation imposed upon it hereunder and is not such party’s fault, and the prevention or cessation of which event is beyond the reasonable control of such party.

Force Maieure means the failure of Borrower to perform any obligation hereunder by reason of any act of God, enemy or hostile government action, terrorist attacks, civil commotion, insurrection, sabotage, strikes or lockouts or any other reason primarily due to cause or causes beyond the reasonable control of Borrower or any Affiliate of Borrower.
