First Foundation has the meaning set forth in the preamble to this Agreement.

First Foundation means First Foundation Bank, in its capacity either as a Lender or in its individual capacity, as applicable, and its successors or assigns.

The Sub-Adviser has the right to use the name “First Foundation” and “FFA” in connection with the Sub-Adviser’s services to the Trust and, subject to the terms set forth in Section 8 of this Agreement, the Trust shall have the right to use the name “First Foundation” and “FFA” in connection with the management and operation of the Fund until this Agreement is terminated as set forth herein. First Foundation. The Sub-Adviser has granted to the Trust and Adviser a license to use the name “First Foundation” (the “Name”) as part of the name of the Fund for the duration of the Management Agreement. The foregoing authorization by the Sub-Adviser to the Trust and Adviser to use the Name as part of the name of the Fund is not exclusive of the right of the Sub-Adviser itself to use, or to authorize others to use, the Name; the Sub-Adviser acknowledges and agrees that, as between the Sub-Adviser and the Adviser, the Sub-Adviser has the right to use, or authorize others to use, the Name, and the Adviser agrees to take such action as reasonably may be requested by the Adviser to give full effect to the provisions of this section.

  • River means a flowing body of water or a portion or tributary of a flowing body of water, including streams, creeks, or impoundments and small lakes thereon.
